Case Summary:
A consultant from India hired North America Immigration Law Group (NAILG) to file an EB-2 NIW (National Interest Waiver) petition on his behalf. Barely 3 months later, he received notification of case approval. As his case was approved after December 27th, 2016, it was adjudicated based on Matter of Dhanasar, the new framework implemented by the USCIS to determine NIW eligibility.
So what qualified our client for the national interest waiver? For one, his 3 publications had gathered 46 citations at the time of filing. Further, we determined that his work on developing the process chemistry and formulation of vaccines leads to the development of more effective vaccines that better protect Americans against influenza.
Not only did we persuade the USCIS that our client’s work has both substantial merit and national importance, we also established that he is well positioned to advance the field of medicinal chemistry. Further, we determined that on balance, it would be beneficial to the United States to waive the requirements of a job offer and thus of a labor certification.
