Case Summary:
Nearly 9 months after North America Immigration Law Group (NAILG) filed an EB-2 NIW (National Interest Waiver) on behalf of an Iranian research assistant, the USCIS finally approved his petition.
So what did it take to attain petition approval? For one, we detailed the 11 peer-reviewed journal articles and 7 peer-reviewed conference articles in our client’s name. We also used Google Scholar to confirm his citation count: 56 citations at the time of filing. What’s more, we included information on his degree, CV, and employment. Leaving no stone unturned, we also detailed his work on the use of mathematical analysis to improve technology. After much scrutiny, we determined that our client’s research results have directly contributed to improving many industrial and scientific applications of nanotechnology. Additionally, his scanning probe microscope research efforts are contributing to the United States’ scientific research abilities and nanotechnology development.
What did we do to fortify the petition? We urged our client to reach out to a handful of other experts in the field of mechanical engineering. We needed them to sign recommendation letters attesting to the significance of his work to the United States. Not long after we helped our client select potential recommenders, he returned with six letters, all of which advocated for the approval of his NIW petition. This is what one of our client’s recommenders had to say about him: “Without his continued participation in this area of study, many United States industries will suffer costly setbacks as research will not generate sufficient improvements to advance nanotechnologies.”
Several months after we filed our client’s case, the USCIS issued a Request for Evidence, which we promptly responded to. We also raised a service request on our client’s behalf once the case was outside the average processing time, and the USCIS ultimately granted their approval. We congratulate our client for securing the national interest waiver. And we thank him for working with us.
