Case Summary:
A tenure-track assistant professor from India hired North America Immigration Law Group (NAILG) to put together and file an EB-1B (Outstanding Professors and Researchers) petition on his behalf. As EB-1B is an employer-sponsored visa category, our client had to garner his employer’s full support before signing the retainer agreement. His employer—an American university—offered their full support and provided our firm with all the necessary paperwork needed to represent our client.
To prove that our client is an outstanding researcher in his field of geoscience, we prepared an EB-1B petition that contained the following information:
- Details on our client’s Ph.D. in Oceanography, CV, and research efforts in the field of geoscience were noted. We demonstrated that his research addresses some of our nation’s most pressing issues in understanding water quality and the environmental factors that impact it.
- We also noted our client’s impressive publication record: 9 peer-reviewed scientific journal articles and 1 conference paper. As his papers were published in several of the most prestigious scientific journals, we proved to the USCIS that our client’s research results have been acknowledged as some of the most influential in the field.
- According to Google Scholar, our client’s work had gathered 69 citations at the time of filing—a notable figure. This proved his original contributions to the field, especially considering that his work is being used by other researchers to collectively progress the field of geoscience.
- An important element of our client’s EB-1B petition involved the five recommendation letters signed by other well-known geoscientists. According to one of them: “[Client] is a scientist of superb skill that has used his time to make potent finds in water resource studies that few would be able to achieve. [Client] has used new technologies and approaches to study a spectrum of topics, and in so doing has shown why he has the qualities desirous of one of the best researchers in his field”. We have no doubt that these recommendations provided valuable evidence that our client is a researcher who deserves to continue his work in the United States.
Thanks to Premium Processing (PP), we only waited 12 days for the USCIS to take action on our client’s petition. Without PP, our client would have had to wait 4-9 months, but because he opted to pay $1,225 extra for this add-on service, he received notification of case approval in less than 2 weeks. We congratulate our client on this win and thank him for retaining our I-485 services. We look forward to helping him and his spouse obtain their green cards.
