Success Stories: Thanks to Our Experts, a Postdoctoral Researcher from Nepal in Biochemistry Gets NIW Approval Despite RFE

Client’s Testimonial:

“I truly appreciate your help in this filing process.”

On May 31st, 2022, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Researcher in the Field of Biochemistry (Approval Notice).

General Field: Biochemistry

Position at the Time of Case Filing: Postdoctoral Researcher

Country of Origin: Nepal

State of Residence at the Time of Filing: Maryland

Approval Notice Date: May 31st, 2022

Processing Time: 9 months, 6 days

Case Summary:

Cancer is the second leading cause of death in the United States, second only to heart disease, and the increasing prevalence of this disease among Americans clearly demonstrates the urgent need for novel research into the improvement of cancer diagnostic and treatment methods. There is accordingly an urgent national need for continuing contributions of people such as our client who is an expert in the field of biochemistry and is working as a post-doctoral research associate. It is vital for improving the efficiency of drugs used to treat cancer. His continuing work helps reduce the increasing burden cancer is placing on Americans.

Knowing this, it was apparent to us that the client’s NIW (National Interest Waiver) petition had merit and thus, we employed our expert team to be quickly done with the formalities. Once the formalities were out of the way, they started building a winning case for them by looking into his academic and professional background. We were able to discover that as an expert in the field of biochemistry, his proposed endeavor is to continue his research into the development of state-of-art drug delivery systems to improve the efficiency of drugs used to treat various cancers, such as metastatic breast cancer. At the same time, his research has resulted in 5 peer-reviewed journal articles (1 of them first-authored). Not only this, but his research has also gone on to influence his peers. That is, his publications have been cited a total of 183 times according to Google Scholar. Furthermore, his study has received funding from the NSF.

He was also able to gather 4 letters of recommendation from dependent and independent scholars in the field. Two of these are quoted below:

“[Client’s] research on BODIPY photocages and improved CTSB inhibition have implications in triple-negative breast cancer treatment. He has proven that his method is able to kill harmful cells, stimulating further research by his peers. As such, [client’s] work is inherently valuable, and he is an exceptional asset to the U.S.”

“The more expensive medical equipment is, the more imaging procedures cost US citizens out-of-pocket. One way to combat expensive medical costs is to create more cost-effective equipment. [Client’s] work allows for the development of efficient and affordable medical imaging equipment that is applicable to cancer detection and treatment.”

These pieces of information put together made for a very effective petition letter. Despite our meticulous presentation of our client’s strong credentials, the USCIS issued a Request for Evidence (RFE). As soon as we received the RFE, our legal team sprang into action. We promptly responded to the RFE and successfully dealt with all hesitations about our client’s qualifications. We are glad to have had the opportunity to help him in this process. We wish him the very best in life and in all future endeavors.
