Case Summary:

EB-2 NIW cases require that each petitioner prove that they seek employment in an area of substantial intrinsic merit, the proposed benefit of the client’s current work is national in scope, and the national interest would be adversely affected if a labor certification were required. In this case our client was a current PHD student in the field of Pathology. Specifically this client’s field of research primarily focused on chronic inflammation and how the resulting exposure of the cells to long-term stress is a critical pregenitorial step in leading to several human diseases. Because of the scope of this research we set out to prove its importance with respect to the national interest of the United States.

This client’s work had resulted in at least 6 peer reviewed scientific article, 11 published conference abstracts, 4 oral presentations, and 8 poster presentations. Moreover, this client’s accomplishments have led to the uncovering of the molecular mechanisms and biological implications of severe skin cancers where they serve to directly support clinical endeavors. We at Chen Immigration Law Associates used these two facets of our client’s portfolio, both scope of research and accomplishments, to prove all prior mentioned criterion.

In addition we drafted independent advisory opinions from unaffiliated researchers in our client’s field of study to bolster weaker parts of our client’s portfolio. Within these letters these researchers had this to say about our client: “Ms. X’s research analyzes the selective signaling cascades that underlie the aforementioned properties and develops more effective ways of treating cancer cells without disrupting or damaging the surrounding healthy tissue. Any progress made in these areas would go a long way toward improving the lives of countless people suffering from cancerous diseases” as well as “Ms. X possesses a unique skill set that allows her to examine some of the most important questions in the area of immunology of the skin, which are directly tied to the national health problems identified by the NIH.”
