On April 5th, 2013, we received a EB-2 NIW (National Interest Waiver) Approval for a PhD Student in the field of Dermatology and Cancer Biology (Approval Notice)

When petitioning for EB2 NIW (National Interest Waiver) cases, we at Chen Immigration Law Associates submit evidence that proves that 1) our clients seek employment in an area of substantial intrinsic merit, b) the proposed benefit of our clients’ current work is national in scope, and c) the national interest would be adversely affected if a labor certification were required.

We proved that this client met the first criterion through highlighting his credentials as well as the importance of her research. This client had several master’s degrees, and will complete her PhD in May of 2013. Although our client is still a graduate student, she has made significant contributions to the field of dermatology and cancer biology. Specifically, her research has enabled necessary advancements leading to an enriched and critical understanding of chronic inflammation, which results in severe skin conditions and other human diseases such as cancer. Advancements in research uncovering the molecular mechanisms and biological implications of these diseases serve to directly support clinical endeavors. These developments benefit the public health and healthcare providers within the United States by facilitating progressive studies that enable adoptable and enhanced treatment methods for these conditions. Our claim that these findings have important implication was corroborated by senior researcher’s comments: “[The petitioner’s] research analyzes the selective signaling cascades that underlie the aforementioned properties and develops more effective ways of treating cancer cells without disrupting or damaging the surrounding healthy tissue. Any progress made in these areas would go a long way toward improving the lives of countless people suffering from cancerous diseases.” Through such developments, our client has made and will continue to make original and significant contributions in her field.

Secondly, we gathered evidence to support the second criterion that our clients’ current work is national in scope. We did this by illustrating the contributions made by this client to her field. These contributions included at least 7 peer-reviewed scientific articles published in leading journals, 12 published conference abstracts, 4 oral presentations, and 9 poster presentations – a productive and exemplary record compared to that of her peers in the mutual field of research. In addition, it should be noted that our client’s publications have been cited at least 175 times according to Google Scholar. These citations are by independent and leading researchers from prestigious institutions around the world, indicating the major significance of these findings.

Lastly, we at Chen Immigration Law Associates proved that the national interest would be adversely affected if a labor certification were required for this client. This was accomplished by drafting independent advisory letters from professionals and researchers who work in the same field as our client. When drafting these letters we always make sure that they are of the highest quality so as to ensure a swift and irrefutable case approval. In this case we obtained letters with a statement such as the following: “[The petitioner’s]studies have the potential to save lives. The work that she is doing is of the utmost importance, as it provides the knowledge base needed to develop a more effective treatment for melanoma, which affects millions of Americans.” Another recommender noted, “Her unique skills in constructing clinical studies that address important questions in the area of common dermatological and allergic diseases are sure to result in her continued research success. These skills place [the petitioner] among a select group of her peers even at this early stage in her career and ensure that her continued work in the United States will translate into direct benefits for the health of the American public.”

Using this proven strategy, while correctly articulating the importance surrounding this client’s valued work, we at Chen Immigration Law Associates were able to secure approval for this petition on April 5th, 2013.

With this in consideration, it is important to emphasize the processes and expertise practiced by Chen Immigration Law Associates. Not only do we develop the best possible strategies for each case, but we execute these strategies with the utmost effectiveness.
