Case Summary:

 

An assistant professor hired North America Immigration Law Group (WeGreened.com) to help him obtain permanent residency for himself and his family. Our legal team submitted an EB-1B (Outstanding Professors and Researchers) petition on his behalf, with his employer—a university—serving as the petitioner.

With a Ph.D. in Agronomy, 12 published journal articles that had collected 38 citations, and 46 instances of peer review service, our client was a suitable EB-1B candidate. In preparing the petition, we demonstrated that his research on crop production and management was essential to the United States’ efforts to promote productivity and improve soil health. We proved that our client’s work improved food availability, environmental sustainability, and the country’s overall economy. To further strengthen our EB-1B petition, we included recommendation letters volunteered by other influential agronomists, one of whom attested to the value of our client’s work by stating, “This work has provided valuable information about water requirements for various crops, including alfalfa, silage corn, and grain sorghum […] he noted that it is important for farmers to keep irrigation inefficiency in mind as well, since this adds to the total amount of water needed to sustain healthy crops.”

Although the USCIS issued a Notice of Intent to Deny (NOID), our legal team worked diligently to convince them that our client’s I-140 (first step in the green card process) petition should be approved. The USCIS agreed with our argument and granted their approval five weeks later. As our client opted to file I-485 (final step in the process) applications for himself and his family while his I-140 was pending, he received the good news that the USCIS had approved their applications not long after.
