Case Summary:

Over two years ago, a research associate from China contracted our law firm to help him get one step closer to a green card via EB-1A (Alien of Extraordinary Ability). Here are some of the steps that we took to ensure that this case received an approval notice:

Step 1: Understanding our client’s role in the field

In a nutshell, cell biology is a branch of biology that focuses on the various structures and functions of a cell. From its life cycle to its organization, cell biologists understand the importance of studying this unit of life as it progresses various other fields in the process. North America Immigration Law Group (WeGreened.com) convinced the USCIS that the United States needs our client’s help to further advance this complex field.

Step 2: Compiling the relevant information to create a strong case

We put together a well-thought-out petition packet that highlighted our client’s crucial role in the field. From carefully detailing his research projects on elucidating the molecular mechanisms underlying stem cell maintenance and differentiation and plant cell defense mechanisms, to counseling him to gather recommendation letters from other experts in his field, our law firm worked diligently to make this EB-1A petition a strong one. One of the recommendation letters that our client obtained stated that “[Client’s] work has been focused on areas critical to enhancing food security and production, the benefits of which are felt well beyond the research sphere alone. His commitment to our health and growth as a society through his incomparable research efforts indicates the value of providing continued support to his efforts.” These letters undoubtedly played a role in fortifying our EB-1A case as it proved the value of our client’s work to the nation.

Our legal team also summarized the 316 citations to our client’s 15 publications, and highlighted the 66 times he conducted peer reviews for high impact scientific journals. We used our client’s professional triumphs as evidence that he dominates the field and that his insights are relevant to the scientific pursuits of other researchers.

Step 3: Playing the waiting game

After months of meticulously preparing our EB-1A petition packet, we filed the case on our client’s behalf. Two and a half months later, our client decided to upgrade his case to be adjudicated under Premium Processing. This allowed him to cut down the average wait time from 5-10 months to a mere 15 days. Sure enough, 7 days after our client upgraded his case, the USCIS issued an approval notice. We join our client in celebrating this milestone and we wish him all the best as he embarks on the final leg of his green card journey: the I-485 application.
