Case Summary:
A technical lead working in the field of computer science approached North America Immigration Law Group to help him navigate the complex green card process. As he wanted to file his I-140 petition under EB-1B (Outstanding Professors and Researchers), he had to get his employer’s full support before engaging our services. After our client confirmed that his employer (a private company) was willing to serve as his petitioner, a privileged attorney-client relationship was established and we got to work putting together a strong EB-1B petition on his behalf.
Composing a firm petition:
Despite EB-1B being an employer-sponsored visa category, we had to prove to the USCIS that our client’s work benefits not just his company, but the United States as a whole. We worked diligently to put together a convincing petition packet that highlighted his outstanding performance in the field. Amongst other things, we detailed his Ph.D. in Electrical Engineering and Computer Science and established that he is well-equipped with the theoretical knowledge to carry out impactful investigations. We also noted the 99 citations to his work, his 10 published scientific articles, and the 15 times he conducted peer reviews for a handful of scientific journals.
Gathering further evidence:
As part of our efforts to present a strong EB-1B case to the USCIS, we helped our client narrow down a list of potential recommenders who could contribute strong testimonials supporting the value of his work on developing novel tools and algorithms for the design and verification of embedded systems. The six expert computer scientists who agreed to lend their support contributed letters that contained statements such as this: “Indeed, [Client’s] career citation count is nearing one hundred, which easily places him among the top researchers in embedded systems.
