Case Summary:
A gifted postdoctoral researcher working in the field of analytical chemistry hired North America Immigration Law Group (WeGreened.com) to file two I-140 petitions on his behalf: an EB-2 NIW (National Interest Waiver) and an EB-1A (Alien of Extraordinary Ability). He chose to file both petitions simultaneously and received his EB-2 NIW approval in February. Although he had to wait an extra 4 months for the USCIS to take action on his EB-1A case, it was worth the wait as he can now file an I-485 application without waiting several years for his priority date to become current.
What did his EB-1A presentation detail?
Our client’s EB-1A petition dossier was composed of a myriad of information pertaining to his various accomplishments in the field. From his doctorate in chemistry to his work on the measurement of molecules, we noted pretty much everything that highlighted our client’s leadership role in the field. At the time of filing, our client’s work had gathered 144 citations, he had published 10 scientific articles, and he had conducted 18 peer reviews for several well-known journals. Taken together, we were able to demonstrate to the USCIS that our client is conducting impactful research and that his findings are progressing not just the work of other analytical chemists, but the American medical sector—particularly in the development of novel microfluidic devices and the discovery of new therapeutic targets.
Like any legal case, we needed evidence to back up our argument (notably the one that stated the importance of allowing our client to continue his work in the US). We tackled this by incorporating recommendation letters that our client gathered from six experts in the field.
