Case Summary:
Just 13 days after North America Immigration Law Group (NAILG) filed an EB-1A (Alien of Extraordinary Ability) petition on behalf of a research scientist from India, the USCIS approved his case. We are extremely pleased that our client is now one step closer to green card success, and we have Premium Processing (PP) to thank for the speedy adjudication. PP is a paid option offered by the USCIS whereby select petitioners willing to pay an additional $1,225 will have action taken on their cases within 15 days instead of 4-9 months.
In order to attain EB-1A petition approval, a petitioner must prove that he/she meets at least 3 out of the 10 requirements set by the USCIS. After carefully evaluating our client’s research background in the field of cancer biology, we determined that he met the following criteria:
- Publication Record: At the time of filing, our client had already published 20 well-received articles, all of which appeared in prominent scientific journals.
- Citation Count: Using Google Scholar and similar sites such as Scopus, we confirmed that our client’s work had collected an impressive 236 citations when we filed his case.
- Peer Review Experience: We were also able to prove to the USCIS that our client had been invited to judge the work of his peers at least 30 times. This criteria is especially noteworthy as it demonstrates the value of our client’s ideas and opinions to other cancer biologists.
Besides the aforementioned points, we also included six recommendation letters in our client’s EB-1A petition dossier. These letters were signed by other well-known researchers, all of whom supported the approval of our client’s petition. According to one of them: “In order to ensure that cancer treatments continue to improve, it is essential to support innovative researchers with a demonstrated record of sustained success. [Client] is one of the top figures in cancer biology, and it is crucial that his research be allowed to continue prospering in this country.”
