Case Summary:
Exactly 13 days after North America Immigration Law Group (NAILG) filed an EB-1A (Alien of Extraordinary Ability) petition on behalf of a postdoctoral fellow from China, the USCIS granted their approval. It usually takes them between 4-9 months to process I-140 petitions but because our client opted for Premium Processing, action was taken on his case within 15 calendar days.
Our goal was to prove to the USCIS that our client is a researcher at the top of the field of medicinal chemistry with sustained national/international influence. Furthermore, we had to demonstrate that the value of his continued research is beneficial to the United States. In preparing his EB1A petition dossier, we made sure that the information presented met at least 3 out of the 10 evidentiary criteria set by the USCIS. For one, we noted the 168 citations gathered from our client’s work. We also listed the 13 peer-reviewed journals articles, 1 book chapter, and 1 granted U.S. patent in his name. Thirdly, we detailed the 50 times he judged the work of his peers.
In our bid to present a strong case to the USCIS, we encouraged our client to reach out to other experts working in the field and ask for letters of support. To make our client’s job a little easier, we helped him narrow down potential recommenders, and not long after, he returned with six signed letters. These letters supported our argument that our client is an individual with extraordinary ability in the field of medicinal chemistry, and that his development and evaluation of novel compounds have major medical benefits. We persuaded the USCIS that his work impacts the US health sector as it is applied in treating ovarian cancer, colon cancer, and other common, deadly and costly diseases.
We are pleased that our diligent efforts paid off and that our client obtained EB1A petition approval. He is now one big step closer to a green card, and we wish him the best as he files an I-485 application with the help of our D.I.Y. Packet.
