Case Summary:

A research specialist from India hired North America Immigration Law Group (NAILG) to help him secure EB-1B (Outstanding Professors and Researchers) approval. He had previously filed another EB1B petition through another firm and received a Notice of Intention to Deny (NOID). After hearing about our firm’s efficient and effective strategies in building strong I-140 cases, he approached us and requested us to take him on as a client. Before we took on his case, we made sure that his employer—an American medical research institute—was willing to serve as the petitioner, and that his credentials met the EB1B requirement.

Preparing a strong EB1B petition:

We included an array of information in our client’s EB1B petition dossier, most of which were related to his work in the field of biochemistry. For instance, we noted the 137 times his 7 publications were cited as well as the three dozen times he assessed the work of his peers. Further, we detailed his work on the development of site-specific drug delivery systems for the targeted diagnosis and treatment of cancer and central nervous system conditions.

Thanks to our client’s comprehensive research summary, we were able to determine that his work addresses some of the United States’ most pressing issues in understanding the molecular functions of cancer and traumatic brain injury, an understanding which guides the development of increasingly safe and effective drug delivery systems.

In a bid to bolster our client’s petition, we advised him to contact several of his peers and ask for recommendation letters. Our client returned with 6 letters, one of which contained this strong statement: “In summary, [Client] is one of the most skilled scientists working in cancer research today. His extensive background in biochemistry and protein engineering makes him uniquely able to handle some of the toughest questions currently facing the field. For this reason, it is absolutely necessary that he may continue with the current direction of his research.”

Although our client initially opted to file his EB1B petition using regular processing, he upgraded it to Premium Processing (PP) roughly 2 months later. By so doing, the USCIS guaranteed that they would take action on his petition within 15 calendar days of receipt of the PP request, which they did (it only took them 10 days). We congratulate our client for surpassing this milestone in the lengthy green card process, and we thank him for retaining us to file I-485 applications for him and his dependents.
