Case Summary:

As he is residing outside the United States, he will undergo a different process to obtain a green card than those based in the country. The first step (the I-140 petition) remains the same but the difference lies in the second and final step. Instead of filing an I-485 application, our client is now eligible for Immigrant Visa Processing (IVP).

What is IVP?

With his EB-1A petition approval, our client can now apply for an immigrant visa at an American consulate or embassy. Amongst other things, he has to submit the right paperwork, pay the fees, and be interviewed by an officer before he can be granted this visa. Assuming that everything goes well, he will be issued a visa stamp that will allow him to enter the United States as a permanent resident. His green card will then be mailed to his U.S. address.

EB-1A Petition:

It must be noted that before being eligible for IVP, our client first had to obtain an I-140 petition approval. His petition was filed under the EB-1A (Alien of Extraordinary Ability) visa category, and thanks to Premium Processing, the USCIS only spent 8 days adjudicating his case.
