Case Summary:
Just 79 days after North America Immigration Law Group (NAILG) filed an EB-1B (Outstanding Professors and Researchers) petition for an Indian postdoctoral research associate, the USCIS approved it. It would have taken far longer had he not opted to upgrade his case to Premium Processing (PP). Merely 5 days after the upgrade, our client received notification of case approval.
Building an EB1B case:
In a nutshell, a petitioner is eligible for classification as an outstanding professor or researcher if he/she satisfies the following three requirements:
- Recognition Internationally as outstanding in a specific academic field;
- Has at least three years of teaching or research in the field;
- Has an offer of a tenured or tenure-track teaching position or a comparable research position, OR the offer of a research position having no fixed term and in which the employee will ordinarily have an expectation of permanent employment, OR the offer of a comparable research position with a private employer if the employer has at least three full-time researchers and documented accomplishments in the research field.
Furthermore, the petitioner’s employer must agree to sponsor the EB1B. In this case, our client garnered his employer’s full support and they provided us with all the necessary documents needed to file the case. Besides these documents, our client’s EB1B petition dossier also contained data on the 39 times his 9 publications were cited as well as the 20 times he assessed the work of his peers. We also detailed his findings on organic synthesis to design, synthesize, and evaluate therapeutic activity of various drug designs and proved their significance to the pharmaceutical industry and overall healthcare goals in the United States.
We worked diligently to prove to the USCIS that our client met the aforementioned EB1B requirements. To further fortify the petition, we included recommendation letters signed by other influential medical chemists, one of whom stated the following: “[Client’s] demonstrated research acumen, coupled with his professional experience, has made him a strong force among his peers, surpassing them in terms of overall success. I can think of few scientists better equipped to continue this important research than [Client], and his work is truly worth investing in.”
We congratulate our client for coming this far in the green card process, and we wish him the best as he adjusts his status for permanent residence by filing an I-485 application.
