Case Summary:

Exactly 15 months and 15 days after North America Immigration Law Group (WeGreened.com) filed an EB-2 NIW (National Interest Waiver) petition on behalf of a postdoctoral scholar from Pakistan, the USCIS granted their approval.

With a Ph.D. in Electrical Engineering and 6 peer-reviewed journal articles (5 of them first-authored) and 8 conference papers, our client seemed like a suitable candidate for the national interest waiver. Before countersigning the retainer agreement, we carefully went through his credentials and asked him questions related to his research to be sure that we could build a strong case for him. Once we determined that we could help our client obtain NIW approval, we got to work gathering a wealth of information pertaining to his work in the field of electrical engineering. Our goal was to present evidence regarding the value of his work to the United States. So how did we do this? For one, we noted his publication record (14 at the time of filing) and the 62 citations gathered from his work.

Furthermore, we listed his research on microelectromechanical systems in the form of micro gas chromatography (µGC) systems for detecting volatile organic compounds (VOCs). Based on the information we had gathered, we were able to persuade the USCIS that our client is contributing to the United States’ ability to monitor air and water samples for VOC identification practically and on a wide scale. We also strengthened the case by including recommendation letters that supported the significance of our client’s work. This statement was extracted from one of these letters: “[Client] is producing groundbreaking scientific work benefiting both academic communities and technologies for improved air quality. His expertise and achievements would be exceptionally difficult to replace were he not able to conduct his research under the best possible conditions.”

Despite the long wait (15.5. months that involved several service requests and our client contacting his congressperson), our client finally obtained the national interest waiver and is now one big step closer to his green card.
