Success Stories: Research Assistant in New York in the Field of Computer Science Secures NIW Approval Thanks to Personalized Petition

Client’s Testimonial:

“Thank you for your excellent service.”

On May 23rd, 2018, we received another EB-2 NIW (National Interest Waiver) approval for a Research Assistant in the Field of Computer Science (Approval Notice).

General Field: Computer Science

Position at the Time of Case Filing: Research Assistant

Country of Origin: Vietnam

State of Residence at the Time of Filing: New York

Approval Notice Date: May 23rd, 2018

Processing Time: 5 months, 24 days

Case Summary:

With an M.S. in Computer Science and many years of experience working in the same field, our client was a shoo-in for the national interest waiver. Even so, we carefully went through his credentials to be sure that we could build a solid case for him based on Matter of Dhanasar (the NIW framework).

After months of hard work, we managed to gather ample information regarding our client’s work on computational genomics. We demonstrated that our client’s research is important to the United States as it tremendously advances the comprehension of DNA, and is a major step forward in the development of new techniques for treatment and diagnosis of previously hard-to-diagnose genetic conditions.

In a bid to strengthen our client’s EB-2 NIW (National Interest Waiver) case, we helped him select recommenders who could advocate for the approval of his petition. Our client reached out to several of them—all expert computer scientists—and asked for recommendation letters. The five letters he gathered played an important role in securing petition approval. This is because these letters contained subjective evidence of the significance of our client’s work to the US. For instance, this is what one of the recommenders noted: “With [Client’s] research, the United States is assured of a healthier populace and its status as a leader in genetic study.” Besides recommendation letters, we also included information on the 65 times his 7 publications were cited.

Although we have helped many computer scientists secure I-140 petition approval, we customized our client’s petition so that it highlighted his specific strengths and achievements. We opted for a unique strategy that took into account his background, field of expertise, and many other factors. With over 10,000 I-140 approvals, we undoubtedly have unprecedented insight into how the USCIS adjudicates cases and exactly what they are looking for.

We congratulate our client for overcoming this significant hurdle in the green card journey, and we thank him for retaining us to help him and his dependents with their I-485 applications.
