Case Summary:
Our client’s Ph.D. in Biomedical Engineering assured us that he has the theoretical and practical knowledge to conduct outstanding research in the field of biomedical engineering. Even so, we carefully evaluated the rest of his credentials to be sure that he was a good candidate for the national interest waiver. Once we determined that he was, we compiled as much relevant information as we could to build a strong EB-2 NIW (National Interest Waiver) case for him.
What did we highlight?
Because we had to prove to the USCIS that our client’s work is of national importance, we detailed his work on regenerative medicine using implantable medical devices. We concluded that his research in this area is of great importance because it focuses in large part on optimizing biomedical devices. As our client’s research focuses on improving implantable device technology for common diseases, such as peripheral nerve injury and osteoporosis, his work is clearly in line with national public health objectives.
We also noted our client’s 13 peer-reviewed journal articles (2 of them first-authored), 2 book chapters, 1 patent and 1 patent application, and the 240 citations gathered from his work. As further evidence that our client is a force to be reckoned with, we detailed the 8 times he was invited to judge the work of his peers. We also incorporated four recommendation letters that strongly advocated for the approval of his NIW petition. These letters were volunteered by other influential members of the field, one of whom stated that:
“[Client’s] research has addressed this issue head-on, resulting in innovative new designs that are revolutionizing the regeneration of cartilage. Based on his advancements on this topic and many others, it direct benefit to the United States for his work to continue here in this country, both from a medical standpoint and a financial one.”
