EB1/NIW Credential Test™
What is EB1/NIW Credential Test™
EB1/NIW Credential Test™ is a carefully-designed case-based criteria system, which is used to distinguish a potential applicant's credential for EB1/NIW qualifications in an objective and reliable fashion. Principal Attorney, Victoria Chen, along with technical board of advisors of EB1/NIW successful petitioners and the staff of North America Immigration Law Group, developed the system by devoting enormous time, energy and resources to formulating an extensive statistical study and research of previously adjudicated cases, and AAO decisions and judicial review opinions.
What can EB1/NIW Credential Test™ achieve?
The system of EB1/NIW Credential Test™ is fully compatible with the argument structure of the petition letter. This means that our attorney will produce a successful petition letter for whoever passing EB1/NIW Credential Test™. The petition letter will have sufficient official supporting evidences to convince immigration officers the qualification of the client. We have the confidence because adjudicating officers, who need to follow their internal memos and the law, will not hope their adjudicating cases to be overturned because the decisions are inconsistent with precedents.
How does EB1/NIW Credential Test™ Work?
The system ensures the control the quality of each client's case. The idea of the test is easy: the standards of law are ambiguous but our immense-scope research put them into context and makes approval/denial predicable. For example, one of the criteria in EB1-A is as follows:
DOCUMENTATION OF THE MEMBERSHIP IN ASSOCIATIONS IN THE FIELD FOR WHICH CLASSIFICATION IS SOUGHT, WHICH REQUIRE OUTSTANDING ACHIEVEMENTS OF THEIR MEMBERS, AS JUDGED BY RECOGNIZED NATIONAL OR INTERNATIONAL EXPERTS IN THEIR DISCIPLINES OR FIELDS
However, what membership satisfies this standard? The burden of proof is on the petitioner to prove that the association where he/she is a member qualifies for the legal standard. Because of the ambiguity, you may hear attorneys or internet articles say IEEE senior member is qualified to satisfy this membership requirement of EB1-A application. Or you may hear that membership of Sigma-Xi satisfies the membership requirement. As a matter of fact, neither satisfies the membership requirement, which is already released in previous AAO decisions.
There are many requirements in EB1/NIW categories stated by law, and North America Immigration Law Group have classified all kinds of possible credentials in a wide range of fields of endeavor. These fields include Engineering, Computer Science, Biomedical Science, Electrical Engineering, Biochemistry, Physics, Environmental Toxicology, Organic Chemistry, Materials Science, Computational Biochemistry, Mechanical Engineering, Neurology, Chemical Engineering, Molecular Biology, Nanotechnology, Genetics, Bioinformatics, etc. Therefore, the test can precisely predict if certain evidence will be accepted by the USCIS adjudicating officer in the most updated Two-Part Approach.
After receiving your resume, we will evaluate your credential using EB1/NIW Credential Test™ for free.
