Success Stories: NIW Approval for a Postdoctoral Research Associate from Nepal with 18 Citations in the Field of Watershed Science

Client’s Testimonial:

“I had heard several great things about the service of Chen Immigration in I-140 applications from my friends. However, I was kind of convinced that they would not take my case because of only 13 citations in my research publications (at the time when I contacted them, the number of citations increased to 18 when I sent my I-140 application to the USCIS). To my pleasant surprise, they emailed me back with a positive response and stated to me that they can take me in a regular case. Thereafter, I decided to take them as my attorney for the I-140 application. Their communication system is very efficient and they answer all the questions related to I-140 very well (till we are convinced). They are also flexible enough to change recommenders till last minute when for some reasons some prospective recommenders do not respond. In my case, one of the recommenders rewrote the whole recommendation drafted by Chen Associates in his own style. Chen associates helped me to find a new recommender since they strongly suggested that the rewritten letter would not be good for my case. Furthermore, the best thing about Chen Associates is that they are very serious about the deadlines they have for drafting recommendation and petition letters. I had a lot of issues in finding recommenders in my application, however, they helped me well in the process. I appreciate their whole service of the I-140 package. Furthermore, they have a great do-it-yourself package for the I-485 applications which makes the I-485 application very easy to be self-applied.”

On January 2nd, 2020, we received another NIW (National Interest Waiver) approval for a Postdoctoral Research Associate in the Field of Watershed Science (Approval Notice).

General Field: Watershed Science

Position at the Time of Case Filing: Postdoctoral Research Associate

Country of Origin: Nepal

State of Residence at the Time of Filing: Oklahoma

Approval Notice Date: January 2nd, 2020

Processing Time: 8 months, 11 days

Case Summary:

North America Immigration Law Group (NAILG) helped a postdoctoral research associate from Nepal acquire EB-2 NIW (National Interest Waiver) petition approval. Our client’s research focused on the analysis of climate scenarios for water and agricultural productivity across the United States. We worked diligently to prove to the USCIS that our client is contributing to the agriculture sector of the United States, and his research in this area is of great importance because it expands global access to freshwater. Such access is directly related to human health and sustainable development.

Drafting the Petition:

While preparing his NIW case, we looked at our client’s educational and professional qualifications and included what we learned in the petition packet drafted by us. We noted that he received a Ph.D. in watershed science and had a M.S. in forestry. This was adjudged by the 18 citations accumulated from his 5 peer-reviewed journal articles (4 of them first-authored), 1 peer-reviewed conference article, 1 non peer-reviewed conference article, and 1 book chapter. Apart from this, we also noted his review work of 7 peer reviews conducted for numerous prestigious journals in the field.

Letters of Recommendation:

The NIW petition received a boost from the recommendation letters contributed by other distinguished experts in the field. These letters detailed our client’s academic achievements and research projects, and shed light on the highly urgent nature of his efforts in aiding the United States to have more sustainable power options. Endorsing our client’s continued stay in the country one recommender wrote: “[Client’s] work produces new knowledge that expands our academic understanding of watershed science and hydrology and enhances freshwater resource management in practice. It is therefore clear that his research must be allowed to continue without impediment or delay.”

Although it took a little longer for the approval to come through (8 months and 11 days), we are delighted that our efforts led to his NIW approval. We thank our client for choosing us and we wish him the best as he continues to advance the field of watershed science in the United States.
