Case Summary:

North America Immigration Law Group (NAILG) helped a postdoctoral research associate from Nepal acquire EB-2 NIW (National Interest Waiver) petition approval. Our client’s research focused on the analysis of climate scenarios for water and agricultural productivity across the United States. We worked diligently to prove to the USCIS that our client is contributing to the agriculture sector of the United States, and his research in this area is of great importance because it expands global access to freshwater. Such access is directly related to human health and sustainable development.

Drafting the Petition:

While preparing his NIW case, we looked at our client’s educational and professional qualifications and included what we learned in the petition packet drafted by us. We noted that he received a Ph.D. in watershed science and had a M.S. in forestry. This was adjudged by the 18 citations accumulated from his 5 peer-reviewed journal articles (4 of them first-authored), 1 peer-reviewed conference article, 1 non peer-reviewed conference article, and 1 book chapter. Apart from this, we also noted his review work of 7 peer reviews conducted for numerous prestigious journals in the field.

The NIW petition received a boost from the recommendation letters contributed by other distinguished experts in the field. These letters detailed our client’s academic achievements and research projects, and shed light on the highly urgent nature of his efforts in aiding the United States to have more sustainable power options. Endorsing our client’s continued stay in the country one recommender wrote: “[Client’s] work produces new knowledge that expands our academic understanding of watershed science and hydrology and enhances freshwater resource management in practice. It is therefore clear that his research must be allowed to continue without impediment or delay.”
