On June 25th, 2018, we received another EB-1B (Outstanding Professors and Researchers) approval for a Development Engineer in the Field of Materials Science (Approval Notice).

General Field: Materials Science

Position at the Time of Case Filing: Development Engineer

Country of Origin: India

State of Residence at the Time of Filing: Idaho

Approval Notice Date: June 25th, 2018

Processing Time: 7 Days (Premium Processing Requested)

Case Summary:

Merely one week after North America Immigration Law Group (WeGreened.com) filed an EB-1B (Outstanding Professors and Researchers) petition for a development engineer from India, the USCIS approved his case. Not only did our client have a doctoral degree and ample experience working in the field of materials science, he also had the full support of his employer—an American company—who served as the case’s petitioner.

Qualifying for EB-1B:

EB1B is a subcategory of priority worker and in order to obtain petition approval, we essentially had to demonstrate that our client had achieved international recognition as being outstanding in his field of materials science. We also had to prove that he had over 3 years of research experience and that an American company was willing to petition his case.

Besides that, our client’s EB1B petition contained information related to his research on the application of electrochemical techniques to material fabrication, with a particular emphasis on semiconductor packaging and cleaning solutions. After carefully going through his research summary, we concluded that his work addresses some of the United States’ most pressing issues in developing effective solutions to critical problems impairing the manufacture and operation of semiconductors.

Building a strong EB-1B petition:

Aside from detailed summaries of our client’s research projects, we also discussed the 66 times his 11 publications were cited as well as the 7 times he judged the work of his peers. We also helped him narrow down a list of potential recommenders who could advocate for the approval of his EB1B petition. The six recommenders our client approached were all prominent members of the materials science research community, and they gladly lent their support in the form of recommendation letters. According to one of them: “He has acquired a critical skill set that enables him to produce highly practical research with major implications for the field. Having displayed superior acumen throughout his career, it is clear that [Client] is one of the most talented researchers working in the field today.”

The approval of this EB1B petition is another example of our impressive reputation for helping our clients get closer to their green card goals. With over 10,000 approved cases, there is no denying that we are extremely well-versed in USCIS adjudication trends and what the immigration officers look for in I-140 petitions. We congratulate our client for securing EB1B approval, and we thank him for retaining us to help him adjust his status for permanent residence (filing an I-485 application).

Client’s Testimonial:

“Thanks for your help and handling my case.”

On January 5th, 2018, we received another EB-1B (Outstanding Professors and Researchers) approval for an Associate Research Scientist in the Field of Molecular Biology (Approval Notice).

General Field: Molecular Biology

Position at the Time of Case Filing: Associate Research Scientist

Country of Origin: India

State of Residence at the Time of Filing: New Jersey

Approval Notice Date: January 5th, 2018

Processing Time: 99 Days (Premium Processing Requested)

Case Summary:

Exactly 99 days after North America Immigration Law Group (WeGreened.com) filed an EB-1B (Outstanding Professors and Researchers) petition for an Indian associate research scientist, the USCIS approved it.

Qualifying for EB-1B:

To prove that our client qualified for this I-140 category, we had to prove that he was internationally recognized as being outstanding in his field, that he had at least 3 years of research experience, and that he had an offer of ongoing employment from an American employer. As our client was a researcher at a university, we also had to demonstrate that his position was tenured or tenure-track.

In preparing our client’s EB1B petition dossier, we chose to focus on the 70 citations gathered from his 12 published scientific articles as well as the 11 times he judged the work of his peers. We also emphasized that his research addresses some of the United States’ most pressing issues in understanding molecular mechanisms underlying cell cycle regulation, DNA repair, and carcinogenesis as well as monogenic obesity. We also included recommendation letters signed by other expert biologists, one of whom stated that our client “is one of the most talented researchers working in the field today.”

Responding to the NOID:

Although we presented a strong EB1B case to the USCIS, our client’s petition was issued a Notice of Intent to Deny (NOID)—the USCIS wanted more information regarding our client’s research achievements despite already being presented with comprehensive and detailed data. Not long after we received the NOID notice, we sprang into action and put together a solid response that highlighted the significance of our client’s work to the US and that his credentials were indeed legitimate. As we have successfully petitioned over 10,000 cases, we knew just how to respond to the NOID. Additionally, our strong record with this particular USICS adjudicator gave us unparalleled insight putting together a NOID response with a sufficient amount of evidence.

Roughly 2 weeks after the USCIS received the NOID response package, they approved our client’s EB1B petition. We congratulate him for coming this far in the green card process and we wish him the best as he continues to advance the important field of molecular biology.

Country of Origin: India

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: Illinois

Approval Notice Date: September 27th, 2017

Processing Time: 79 Days (Premium Processing Requested)

Case Summary:

Just 79 days after North America Immigration Law Group (NAILG) filed an EB-1B (Outstanding Professors and Researchers) petition for an Indian postdoctoral research associate, the USCIS approved it. It would have taken far longer had he not opted to upgrade his case to Premium Processing (PP). Merely 5 days after the upgrade, our client received notification of case approval.

Building an EB1B case:

In a nutshell, a petitioner is eligible for classification as an outstanding professor or researcher if he/she satisfies the following three requirements:

  • Recognition Internationally as outstanding in a specific academic field;
  • Has at least three years of teaching or research in the field;
  • Has an offer of a tenured or tenure-track teaching position or a comparable research position, OR the offer of a research position having no fixed term and in which the employee will ordinarily have an expectation of permanent employment, OR the offer of a comparable research position with a private employer if the employer has at least three full-time researchers and documented accomplishments in the research field.

Furthermore, the petitioner’s employer must agree to sponsor the EB1B. In this case, our client garnered his employer’s full support and they provided us with all the necessary documents needed to file the case. Besides these documents, our client’s EB1B petition dossier also contained data on the 39 times his 9 publications were cited as well as the 20 times he assessed the work of his peers. We also detailed his findings on organic synthesis to design, synthesize, and evaluate therapeutic activity of various drug designs and proved their significance to the pharmaceutical industry and overall healthcare goals in the United States.

We worked diligently to prove to the USCIS that our client met the aforementioned EB1B requirements. To further fortify the petition, we included recommendation letters signed by other influential medical chemists, one of whom stated the following: “[Client’s] demonstrated research acumen, coupled with his professional experience, has made him a strong force among his peers, surpassing them in terms of overall success. I can think of few scientists better equipped to continue this important research than [Client], and his work is truly worth investing in.”

We congratulate our client for coming this far in the green card process, and we wish him the best as he adjusts his status for permanent residence by filing an I-485 application.

“Thank you for the great work. I am very happy that this first hurdle is over.”

On March 20th, 2017, we received another EB-1B (Outstanding Professors and Researchers) approval for a Research Specialist in the Field of Biochemistry (Approval Notice).

General Field: Biochemistry

Position at the Time of Case Filing: Research Specialist

Country of Origin: India

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: California

Approval Notice Date: March 20th, 2017

Processing Time: 68 Days (Premium Processing Requested)

Case Summary:

A research specialist from India hired North America Immigration Law Group (NAILG) to help him secure EB-1B (Outstanding Professors and Researchers) approval. He had previously filed another EB1B petition through another firm and received a Notice of Intention to Deny (NOID). After hearing about our firm’s efficient and effective strategies in building strong I-140 cases, he approached us and requested us to take him on as a client. Before we took on his case, we made sure that his employer—an American medical research institute—was willing to serve as the petitioner, and that his credentials met the EB1B requirement.

Preparing a strong EB1B petition:

We included an array of information in our client’s EB1B petition dossier, most of which were related to his work in the field of biochemistry. For instance, we noted the 137 times his 7 publications were cited as well as the three dozen times he assessed the work of his peers. Further, we detailed his work on the development of site-specific drug delivery systems for the targeted diagnosis and treatment of cancer and central nervous system conditions.

Thanks to our client’s comprehensive research summary, we were able to determine that his work addresses some of the United States’ most pressing issues in understanding the molecular functions of cancer and traumatic brain injury, an understanding which guides the development of increasingly safe and effective drug delivery systems.

In a bid to bolster our client’s petition, we advised him to contact several of his peers and ask for recommendation letters. Our client returned with 6 letters, one of which contained this strong statement: “In summary, [Client] is one of the most skilled scientists working in cancer research today. His extensive background in biochemistry and protein engineering makes him uniquely able to handle some of the toughest questions currently facing the field. For this reason, it is absolutely necessary that he may continue with the current direction of his research.”

Although our client initially opted to file his EB1B petition using regular processing, he upgraded it to Premium Processing (PP) roughly 2 months later. By so doing, the USCIS guaranteed that they would take action on his petition within 15 calendar days of receipt of the PP request, which they did (it only took them 10 days). We congratulate our client for surpassing this milestone in the lengthy green card process, and we thank him for retaining us to file I-485 applications for him and his dependents.
