Client’s Testimonial:

“Thank you for your great service.

On August 24th, 2019, we received another EB-2 NIW (National Interest Waiver) approval for a Graduate Student Research Assistant in the Field of Energy Systems (Approval Notice).

General Field: Energy Systems

Position at the Time of Case Filing: Graduate Student Research Assistant

Country of Origin: Iran

State of Residence at the Time of Filing: California

Approval Notice Date: August 24th, 2019

Processing Time: 6 months, 23 days

Case Summary:

North America Immigration Law Group (NAILG) has earned a solid reputation for its efficient handling of I-140 petitions and I-485 applications. The high success rate of EB-2 NIW (National Interest Waiver) petitions handled by NAILG was yet again reflected in the case of an Iranian graduate student research assistant based in California.

Our client’s revolutionary ideas have propelled the field of energy systems into the future. His research initiatives have broadened our understanding of power systems technology and policy, planning, systems analysis, management, and design. In order to prove the significance of our client’s research to the USCIS, we emphasized the way he has been resolving challenges faced by the renewable energy and microgrid industries in the US.

To strengthen the petition, we have included 6 recommendation letters furnished by other experts in his field to discuss how his work sustained national and international acclaim. One of whom had this to say about him, “It is evident that there is a real demand for such improvement as climate change is a global threat. The sheer magnitude of this predicament and the urgency for a solution exacerbate the need for research in the field of energy systems. [Client] is a researcher whose contributions are absolutely vital to the progress of this field”.

Further, we outlined his impressive record of authorship which demonstrates his current accomplishments in the field. At the time of filing, he had already published 2 peer-reviewed journal articles (1 of them first-authored), 8 conference papers (4 of them first-authored) and a first-authored technical report. We also focused on the 57 times his work has been cited by other researchers, and the 30 peer reviews he conducted for highly acclaimed journals. It is clear that his counterparts have recognized the value in what he has accomplished, and have implemented his works and ideas in their own projects.

We join our client as he celebrates the approval of his NIW petition. We are currently waiting for a decision on his I-485 application. Once the USCIS approve his I-485 application, he will become a US permanent resident. We look forward to helping him accomplish this goal and thank him for choosing our law firm to represent his I-140 NIW and I-485 cases.

“Thanks a lot for everything. I was totally happy with how you took care of my case.

On August 1st, 2019, we received another EB-2 NIW (National Interest Waiver) approval for a Researcher and Director of Research and Development in the Field of Applied Linguistics (Approval Notice).

General Field: Applied Linguistics

Position at the Time of Case Filing: Researcher and Director of Research and Development

Country of Origin: Iran

State of Residence at the Time of Filing: New York

Approval Notice Date: August 1st, 2019

Processing Time: 9 months, 17 days

Case Summary:

Based on the framework set by Matter of Dhanasar, our client, an Iranian researcher and director of research and development specializing in applied linguistics was suitably qualified for the national interest waiver. It took the USCIS nearly 10 months to process our client’s EB-2 NIW (National Interest Waiver) petition. The reason the adjudication took this long is because his NIW was issued a Request for Evidence (RFE). However, our stellar team prepared a strong response to it, which ultimately led to case approval. Not only did we convince the USCIS that our client’s credentials were legitimate, we also reiterated that he is an asset to the United States.

Besides chronicling our client’s doctoral degree, we included other relevant evidence of our client’s unique skill sets and knowledge. By the time we were ready to file his case, we had amassed an extensive list of his accomplishments. For instance, our client’s 5 peer-reviewed journal articles and 4 technical reports had collected 41 citations. He had also assessed the work of his peers for 12 times. Further, we thoroughly accounted for his research on the use of quantitative analysis methods in second language acquisition studies and assessments.

In the petition letter, we presented sufficient evidence on the benefits of his work to the United States, and emphasized that he is one of only a small handful of researchers who can obtain such impactful research results. Specifically, our client’s research are able to provide insights crucial for the advancement of social factors, as well as speech recognition technology, AI, and more. His research on the use of quantitative analysis methods in second language acquisition studies and assessments therefore extends beyond the academic arena, and is beneficial to the national interests of the United States.

To further strengthen our client’s NIW petition, we included 6 recommendation letters signed by other prominent members of the applied linguistics research community. These letters discussed our client’s various studies, their significance to the field, and the importance of allowing our client to remain in the US to conduct his research. According to one of the recommenders: “In general, applied linguistics is an interdisciplinary field that seeks solutions to language-related real-life problems. Applied linguistics receives input from psychology, education, anthropology, and sociology, among many other fields, and focuses on providing new resources and policies for language learning and cultural understanding around the globe. Thus, this field is a holistically beneficial one, serving the advancement of society in general. [Client]’s activities in this arena have proven to be enormously significant to the progress of applied linguistics”.

Our unprecedented insight into how USCIS officers adjudicate I-140 cases has taught us how to build personalized petitions for our clients. We are glad that our hard work paid off and that he secured the approval of national interest waiver. This approved NIW petition is one of nearly 15,000 petitions that we have helped our clients obtain. We thank him for choosing our firm, and we wish him the very best in his future endeavors.

On July 20th, 2019, we received another EB-2 NIW (National Interest Waiver) approval for a Research fellow in the Field of Biochemistry (Approval Notice).

General Field: Biochemistry

Position at the Time of Case Filing: Research fellow

Country of Origin: Lebanon

State of Residence at the Time of Filing: Massachusetts

Approval Notice Date: July 20th, 2019

Processing Time: 5 months, 16 days

Case Summary:

An EB-2 NIW (National Interest Waiver) petition approval was granted to a biochemistry Lebanon-born research fellow based in Massachusetts. After our careful initial evaluation, we confirmed that our client’s consistent contributions to the field have made him a suitable candidate for I-140 EB-2 NIW (National Interest Waiver). As our team worked diligently to put together a customized petition, his NIW was approved in just 5.5 months.

We were tasked with proving to the USCIS that our client’s continued work on the application of genetics, molecular biology, cell biology, bioinformatics, yeast, and cancer research helps to better understand cellular regulation and adaptation to environmental conditions. Through advanced scientific understanding on the development of effective and efficient treatments for a wide range of diseases that affect animals, plants, humans, and the environment, our client’s findings holds significant implications for improving public healthcare strategies, environmental stability, and scientific progress regarding several widespread and pervasive diseases in the United States.

We highlighted the 160 citations gathered from his 14 peer-reviewed journal articles and 1 book chapter, and the 5 times he assessed the work of his peers for scientific journals in the petition letter. Above evidence underscored the invaluable nature of our client’s work with protein mechanisms and functions in disease development, as his research has contributed to ongoing international efforts to provide enhanced care for individuals diagnosed with cancer and other conditions.

As part of our services, we helped our client narrow down a list of biochemistry experts who could potentially serve as recommenders. We made sure that these recommenders were familiar with our client’s publications and/or had worked with him. Not long after we supplied our client with the list, he returned with 4 signed letters, one of which contained this strong statement: “[Client]’s work in biochemistry has refined the broader scientific community’s understanding of the most fundamental mechanisms within cellular processes. His work to reveal the structure and function of cellular components has far-reaching consequences for scientists developing treatments for an array of health concerns”.

As our client currently resides in the US, he will embark on the final leg of the green card journey by filing an I-485 application (the other option involves undergoing immigrant visa processing for applicants who are based outside the US). We thank him for also retaining our firm’s I-485 service, and we look forward to helping him secure green card success.

“Thank you very much for your work on my I-140 application. I appreciate your hard work on my application. The process was well-designed and there were detailed instructions for each step of the process. The drafted petition letter was well-written and presented my research and its importance to US perfectly.

On August 1st, 2019, we received another EB-2 NIW (National Interest Waiver) approval for a Sr. Operations Research Analyst in the Field of Transportation Engineering (Approval Notice).

General Field: Transportation Engineering

Position at the Time of Case Filing: Sr. Operations Research Analyst

Processing Time: 7 months, 27 days

Case Summary:

A senior operations research analyst from Iran secured EB-2 NIW (National Interest Waiver) approval in less than 8 months after North America Immigration Law Group (WeGreened.com) filed the petition on his behalf. With 8 peer reviews as well as 28 citations gathered from his 4 peer-reviewed journal articles and 2 technical reports, our client’s work in the field of transportation engineering has been well-received by other researchers, several of whom contributed letters of recommendation in support of his NIW petition.

Adjudicated and approved based on Matter of Dhanasar, the USCIS clearly agreed with our argument that our client’s research on modeling complex design and investment-optimization problems for large-scale transportation networks which directly contributes to the American transportation networks and infrastructure has has both substantial merit and national importance. Since transportation networks are vital aspects of the economy and supply chains, his findings directly support the enduring success and productivity of countless US businesses, including the manufacturing, shipping, transport and consumer industries.

Our client has created a mathematical model that optimally selected the most effective and valuable set of actions to guard a transportation network against sea-level rise and flooding scenarios in one of his major research project. By improving the ways in which the country optimizes infrastructure against flooding, his studies and models contribute not only to alleviate the economic burden associated with infrastructure spending but also guides the government toward making the most efficient infrastructural investments that sustain transportation networks for decades to come.

Besides listing our client’s achievements, we have also incorporated 6 letters of recommendation signed by other distinguished experts in the field. According to one of them: “The building of new and resilient infrastructure and recovery efforts also have costs. [Client] must be recognized for his work addressing this concern. [Client] has built a methodology which estimates network resilience, thereby allowing the U.S. to reduce its spending by making the most effective investments”.

Our client has also retained our firm to help him file I-485 (Adjustment of Status) concurrently, along with an I-765 (application for EAD) and I-131 (application for AP). Given that he already has a valid non-immigrant visa status in the US, a pending I-485 and EAD allows him to legally remain in the United States and be employed should he lose his non-immigrant visa status. We congratulate him on his NIW win and thank him for choosing us to help him to adjust status for US permanent residency.

On February 4th, 2019, we received another EB-2 NIW (National Interest 7Waiver) approval for a Researcher in the Field of Electrical Engineering (Approval Notice).

General Field: Electrical Engineering

Position at the Time of Case Filing: Researcher

Country of Origin: Nigeria

State of Residence at the Time of Filing: Texas

Approval Notice Date: :February 4th, 2019

Processing Time: 6 months, 22 days

Case Summary:

With an M.S. in Electrical Engineering and many years of experience conducting network communications modeling research, this PhD candidate from Nigeria was a good fit for EB-2 NIW (National Interest Waiver). After evaluating his credentials, we determined that we could help him secure the national interest waiver. With over 12,000 approved I-140 cases in the bag, the team at North America Immigration Law Group (NAILG) knew just what type of legal strategy to take in order to secure petition approval.

To build a strong case, we spent several months gathering a wealth of useful information pertaining to our client’s research in the field of Electrical Engineering. We carefully reviewed and summarized his research focus on network communications modeling by expanding RF signal processing methods to include machine learning and studying innovative wireless network enhancement techniques. We also listed the 24 times his 2 peer-reviewed journal articles and 5 peer-reviewed conference papers were cited, along with the 6 times he conducted peer reviews for a well-known scientific journal.

Additionally, to support his NIW petition, we submitted six recommendation letters contributed by his peers. The six letters played an important role in securing petition approval as they provided the USCIS with subjective evidence that our client is widely respected within the scientific community. For instance, one of his recommenders noted in the letter: “[Client] has produced models, algorithms, and analytical systems of tremendous benefit to the United States, firmly establishing himself as an asset to the technological and financial interests of this country. If [client] is not permitted to continue his research in the United States, I foresee significant setbacks in research progress and the development of optimization strategies for wireless communications networks… The United States relies heavily on the work of experts such as [client] to improve existing communications networks and develop new approaches to monitoring, managing, and stabilizing wireless networks and systems.”

After 6 months and 22 days of deliberation, the USCIS granted the approval of our client’s NIW petition. We thank our client for choosing us and congratulate him for overcoming this significant hurdle in the green card journey. We also wish our client the best as he continues to carry out impactful research.
