On February 28th, 2018, we received another EB-1A (Alien of Extraordinary Ability) approval for an Assistant Professor in the Field of Physical Therapy (Approval Notice).

Case Summary:

With a doctoral degree and ample experience working in the field of physical therapy, an assistant professor from China seemed to be a perfect fit for EB-1A (Alien of Extraordinary Ability). Before we took on her case, we carefully evaluated her credentials to be sure that we could build a solid case for her. Once we confirmed that she met at least 3 out of the 10 requirements needed to qualify for EB1A, we countersigned the retainer agreement and got to work.

What were the 3 EB1A requirements?

Based on our client’s research and educational background, we concluded that she had (1) Contributed to the filed in a major way, (2) Authored scholarly articles in well-known publications, and (3) Acted as a judge of other in her field. At the time of filing, we established that our client’s work had amassed 105 citations, that she had published a dozed scientific articles, and that she had judged the work of her peers 25 times.

Including additional evidence:

Besides proving that our client met at least 3 EB1A criteria, we detailed her work on rehabilitation for patients with Parkinson’s disease. Further, we urged her to obtain recommendation letters from several of her peers. These letters played an important role in securing petition approval as they highlighted the value of our client’s work not just to the field of physical therapy but to the United States as a whole. According to one of our client’s recommenders—an assistant professor based in Canada—our client’s research “… greatly benefits the citizens, health care providers and researchers of United States, which undoubtedly illustrates the significant value she brings to your country.”

Although we presented a strong case to the USCIS, our client’s EB1A petition was issued a Request for Evidence (RFE). Our team strategized and put together a solid response to the RFE, which ultimately led to case approval. We are pleased that we managed to convince the USICS that our client is an extraordinary researcher whose work is widely applied in areas such as physical therapy for improved medical treatment for Parkinson’s disease.
