Thanks.”

On August 22nd, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for a Research Scientist in the Field of Applied Semiconductor Engineering (Approval Notice).

General Field: Applied Semiconductor Engineering

Position at the Time of Case Filing: Research Scientist

Country of Origin: China

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: Illinois

Approval Notice Date: August 22nd, 2016

Processing Time: 7 months, 24 days

Case Summary:

North America Immigration Law Group (WeGreened.com) was hired by a prominent research scientist from China to file two I-140 petitions on his behalf: an EB-2 NIW (National Interest Waiver) and an EB-1A (Alien of Extraordinary Ability). He chose to file the EB-2 NIW petition first and once it was approved, his EB-1A. Our client’s approved EB-1A petition allowed him to move forward with the final step of the green card process (filing an I-485 application) without waiting several years for his priority date to become current.

What role did our law firm play in the process?

As the attorney-on-record, we were tasked with a myriad of responsibilities. From building two strong cases for our client to communicating with the USCIS on all related matters, we did it all. When it came to the EB-1A petition packet, these are some of the key points that we chose to focus on:

  1. We spared no expense when it came to detailing our client’s impressive portfolio of research projects. Thanks to the comprehensive research summary that he provided us, we learned that his investigations are focused on Microelectromechanical system (MEMS) technology, which is important for diversifying the functions of microchips, and integrated circuit (IC) manufacturing technology, which is critical to continue shrinking device size and improving performance for microchips. We demonstrated to the USCIS that our client’s findings improve American semiconductor technology, which is vital for advancements in information technology.
  2. We needed to prove that our client’s work impacts not just the semiconductor industry in the US, but also the work of other applied semiconductor engineers around the world. Amongst other things, we noted his 4 publications, the 50 times his work was cited at the time of filing, and the 8 times he conducted peer reviews for 3 scientific journals.
  3. To further fortify our client’s EB-1A petition, we incorporated recommendation letters which our client obtained from six other influential members working in the field. According to one of them (a well-known professor), without our client’s work, “… the United States can expect to see delays in future progress, as he is a significant contributor to this line of work. I am a strong proponent of [Client’s] research, and look forward to the work that he will complete in the coming months and years.

We congratulate our client for obtaining an EB-1A petition approval less than 8 months after the case was filed. On top of that, the USCIS did not issue a Request for Evidence (RFE), which would have lengthened the overall timeline. We wish our client the best with his continued research efforts and thank him for choosing our law firm to represent both his EB-1A and EB-2 NIW petitions.

On April 29th, 2016, we received another EB-1B (Outstanding Professors and Researchers) approval for an R&D Yield Enhancement Engineer in the Field of Micro-electronics Engineering (Approval Notice).

General Field: Micro-electronics Engineering

Position at the Time of Case Filing: R&D Yield Enhancement Engineer

Country of Origin: India

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: Idaho

Approval Notice Date: April 29th, 2016

Processing Time: 9 months, 30 days

Case Summary:

Nearly 10 months after we filed an EB-1B (Outstanding Professors and Researchers) petition on behalf of an engineer from India, the USCIS took action on his case and granted their approval. As EB-1B is an employer-sponsored visa category, our client had to get his company’s full support before hiring North America Immigration Law Group (WeGreened.com) to represent his case. Once we had gathered all the relevant paperwork from our client’s employer (a private tech company), we proceeded to put together a persuasive EB-1B petition dossier on his behalf.

Determining why our client is important to the nation:

Because we needed to prove that our client’s work is of value not just to his employer but to the United States as a whole, we incorporated an array of information that detailed his research projects and their outcome. For instance, we noted the 21 citations gathered from his 8 published scientific articles as well as the 2 times he assessed the work of his peers. Additionally, we relayed the importance of our client’s work on microelectromechanical systems (MEMS) and semiconductor technology to the USCIS in an efficient and effective manner. For one, we established that our client’s findings are applied in bio-medical screening, radiation leakage investigation, and military surveillance—three sectors whose progress is essential to the United States.

Presenting evidence to the USCIS:

Like any good legal case, we had to ensure that we had solid evidence to back up our argument. We did this by encouraging our client to ask other influential members of the micro-electronic engineering community for recommendation letters. We needed these professionals to verify that our client is conducting outstanding research and that he is an internationally recognized researcher. Our client promptly returned with six signed recommendation letters, one of which stated that “[Client] has already produced research that is valuable to the United States, as he has aided in educating future engineers from the elementary to graduate school level about micro and nano technology. His current work enables both industry and government to develop products important to global business as well as national security. Our client’s recommender went on to say that “I have already seen [Client] make solid advancements in micro-nanotechnology and contribute innovative ideas to the field of electrical engineering. I have zero hesitation in saying that he will continue to make these kinds of contributions to his field and to the larger national economy well into the future.”

Taking a step closer to permanent residence:

The USCIS issued a Request for Evidence (RFE) 8.5 months after our client’s EB-1B case was submitted. We efficiently put together a strong response to the RFE which ultimately convinced the USCIS that our client deserved to get one step closer to a green card. We join our client as he celebrates this milestone and we wish him the best as we await a positive decision on his I-485 application (which we filed on his behalf while his EB1B was pending approval). Once the USCIS approves his application, he will become an American permanent resident. In the meantime, we wish him well as he continues to progress the field of micro-electronics engineering.

Client’s Testimonial:

“Thanks for your wonderful work regarding my case.”

On March 15th, 2016, we received another EB-1B (Outstanding Professors and Researchers) approval for a Research Associate in the Field of Pharmaceutical Chemistry (Approval Notice).

General Field: Pharmaceutical Chemistry

Position at the Time of Case Filing: Research Associate

Country of Origin: India

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: Kansas

Approval Notice Date: March 15th, 2016

Processing Time: 2 months, 28 days (Premium Processing Requested)

Case Summary:

90 days after we filed an EB-1B (Outstanding Professors and Researchers) petition on our client’s behalf, we received an approval notice from the USCIS. Although it takes an average of 4-9 months for the USCIS to take action on a petition, we received rapid adjudication because our client chose to upgrade her case to Premium Processing approximately 2.5 months after we initially submitted the petition. She received notification of case approval merely a week after the upgrade.

As EB-1B is an employer-sponsored visa category, our client’s employer—a university—served as the petitioner. Based on our client’s credentials, it seemed that we had a strong EB1B case, and we worked diligently to convince the USCIS that our client’s petition deserved to be approved. We documented our client’s publication record, which at the time of filing stood at six peer-reviewed scientific articles, one book chapter, and five presentations at national and international conferences. We also noted her citation record (42 citations) and peer review experience (6 reviews for 4 prominent scientific journals). Most importantly, we demonstrated the value of our client’s research to the United States. We started by carefully reviewing her various research ventures on improving the long-term stability of vaccines and other pharmaceutically active products, such as any proteins, DNA, macromolecular structures, viruses or virus-like particles, or bacterial cells that are ascribed a medical use. Based on what we learned, we firmly outlined the many benefits that her research brings to the United States, particularly to its pharmaceutical and medical sectors.

Besides detailing our client’s professional accomplishments, we incorporated recommendation letters signed by other leaders in the field of pharmaceutical chemistry. These letters furnished the USCIS with solid proof that our client’s findings impact the work of American and international researchers who are doing all they can to advance the field as a whole. One of her recommenders described her as “… respected by those working within her concentration, and her opinion is held in high-regard. She is a distinguished researcher who stands out among the rest for her consistently reliable research reports. I support her wholeheartedly, and I recommend that her work be considered a priority.”

We are pleased that our efforts and our client’s favorable credentials paved the way for case approval. North America Immigration Law Group (WeGreened.com) recently submitted I-485 applications for our client and her spouse. We hope for a favorable outcome and wish our client the very best with her continued investigations.

Client’s Testimonial:

“I am happy and very excited about my EB1B case [being] approved after [a] couple of RFE’s. I am extremely grateful to the attorneys and other staff at Chen Immigration for handling my case with care and patience and bringing it to a successful completion. I appreciated your effective and very quick work. And I will certainly spread the words among my friends and colleagues […] Thank you very much for your great work!

On March 11th, 2016, we received another EB-1B (Outstanding Professors and Researchers) approval for a Senior Scientist in the Field of Chemistry (Approval Notice).

General Field: Chemistry

Position at the Time of Case Filing: Senior Scientist

Country of Origin: India

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: North Carolina

Approval Notice Date: March 11th, 2016

Processing Time: 14 months, 5 days

Case Summary:

A senior scientist from India hired North America Immigration Law Group (WeGreened.com) to help him attain green cards for himself and his family. Our client chose to file two I-140 petitions: EB-2 NIW (National Interest Waiver) and EB-1B (Outstanding Professors and Researchers). This is very common amongst petitioners as it gives them a higher chance of getting a petition approval. In this case, our client was fortunate enough to receive two approval notices.

Understanding Priority Dates:

We are particularly pleased that the USCIS approved our client’s EB-1B petition because it qualifies him for immediate I-485 application (last step in the green card process) filing—he does not have to wait for his priority date to become current. Because our client was born in India, he has to adhere to the strict quota system that the USCIS has in place: it limits the number of green cards issued to petitioners with EB-2 approvals who were born in India. For instance, petitioners born in India whose EB-2 petitions were recently filed and approved have to wait several years before their priority date becomes current. On the other hand, Indian petitioners with EB-1 approvals need not worry about this as there is no quota in place for them. They may apply for their green cards any time they want.

EB-1B Petition:

Part of our legal services included putting together a convincing EB-1B petition that highlighted our client’s most flattering achievements. From his advanced degrees to his research endeavors on the development and synthesis of pharmaceutical compounds, we detailed it all. By the time we were ready to file the petition, we had amassed a wealth of information on our client: the 50 citations to his work, his 7 publications, 1 patent, and 20 times he conducted peer reviews for scientific journals. We also included recommendation letters provided by other leaders in the field of chemistry. One of them—a prominent professor—wrote, “I see [Client] as a truly noteworthy individual. He has gone above and beyond what is usually expected of someone of his experience level. He stands apart from his peers in the field and should be supported as a top-level researcher.”

RFE and NOID:

Although we presented a strong EB-1B case to the USCIS, they issued a Request for Evidence (RFE) six months after we filed the case, and a Notice of Intent to Deny (NOID) four months after that. Our legal team responded to both notices in a prompt and efficient manner, and as is evident, our expertise paid off and our client’s EB-1B petition was approved.

Pending Filing:

Because our client chose to base his I-485 application on his EB-1B approval, he did not have to worry about the priority date and could carry out pending filing (filing I-485 while the I-140 awaits approval). We are currently helping him respond to an RFE, and once that is completed, we will join him as he awaits a favorable decision from the USCIS. In the meantime, we thank him for selecting our law firm to represent his case and we wish him well as he continues his research.

On February 17th, 2016, we received another EB-1B (Outstanding Professors and Researchers) approval for an R&D Scientist in the Field of Bioanalytical Chemistry (Approval Notice).

General Field: Bioanalytical Chemistry

Position at the Time of Case Filing: R&D Scientist

Country of Origin: China

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: California

Approval Notice Date: February 17th, 2016

Processing Time: 6 months, 26 days

Case Summary:

This EB-1B (Outstanding Professors and Researchers) case involved an R&D Scientist working in the field of bioanalytical chemistry. He hired North America Immigration Law Group (WeGreened.com) to help him obtain a green card, and his employer—a private company—agreed to serve as his petitioner.

Our client is currently developing analytical methods for investigating several properties of carbon nanotubes (CNTs), specifically their toxicity and electron transfer capability, as well as developing platforms for the bioanalysis of drugs. We worked diligently to prove that his original investigations clearly benefit the medical and pharmaceutical industries in the United States, and that their applications positively affect the health of Americans. We bolstered our EB-1B petition packet by incorporating information on our client’s Ph.D. in Environmental Toxicology (to prove that he is well equipped with the knowledge and skills to carry out complex research studies) and details of the 44 citations to his 7 publications (to establish that his research is beneficial to other bioanalytical chemists). Our legal team also highlighted the 13 times our client offered his insights to other researchers through peer reviews. To make this EB-1B case even more airtight, we included six recommendation letters provided by experts in the field. One of these letters stated, “[Client’s] work has already provided invaluable information to other researchers investigating the mechanisms of SWCNTs, and the continuance of his work will certainly provide yet more unique advantages to America in regards to bioanalysis.”

Our legal team raised a service request when the adjudication timeframe went beyond the normal processing time, and a couple of days later, the USCIS approved our client’s EB-1B petition. Soon after, we helped our client and his wife file their I-485 applications, and we look forward to the approval of their permanent residency.

In preparing the petition, we demonstrated that his research on crop production and management was essential to the United States’ efforts to promote productivity and improve soil health. We proved that our client’s work improved food availability, environmental sustainability, and the country’s overall economy. To further strengthen our EB-1B petition, we included recommendation letters volunteered by other influential agronomists, one of whom attested to the value of our client’s work by stating, “This work has provided valuable information about water requirements for various crops, including alfalfa, silage corn, and grain sorghum […] he noted that it is important for farmers to keep irrigation inefficiency in mind as well, since this adds to the total amount of water needed to sustain healthy crops.”

Although the USCIS issued a Notice of Intent to Deny (NOID), our legal team worked diligently to convince them that our client’s I-140 (first step in the green card process) petition should be approved. The USCIS agreed with our argument and granted their approval five weeks later. As our client opted to file I-485 (final step in the process) applications for himself and his family while his I-140 was pending, he received the good news that the USCIS had approved their applications not long after. We would like to congratulate our client on this momentous occasion and we wish him all the best in his future endeavors.
