Client’s Testimonial:

“Thank you very much for your help.”

On January 9th, 2020, we received another NIW (National Interest Waiver) approval for a Biostatistician in the Field of Biostatistics (Approval Notice).

General Field: Biostatistics

Position at the Time of Case Filing: Biostatistician

Country of Origin: Ethiopia

State of Residence at the Time of Filing: Ohio

Approval Notice Date: January 9th, 2020

Processing Time: 7 months, 12 days

Case Summary:

A biostatistician based in Ohio hired North America Immigration Law Group (WeGreened.com) to file an NIW (National Interest Waiver) petition on his behalf. Once we were retained, our dedicated team initiated a comprehensive research on our client’s experience and expertise in order to devise a strong petition. With our help, his NIW was approved in 7 months and 12 days.

After months of hard work, we managed to gather information regarding our client’s work on improving statistical methods for high-dimensional classification and their application to machine learning methods for human health analysis and modeling. We put together a solid case that comprised of an array of information. This included data on our client’s 5 peer-reviewed journal articles (3 of them first-authored) and the 7 times his work was cited. We also noted the 2 times our client judged the work of his peers. Despite the low number of his citation count, he got his NIW approved.

With a PhD in statistics and many years of experience working in the field of biostatistics, our client is a shoo-in for the National Interest Waiver. We demonstrated that our client’s research in his area is of great importance because it contributes to more effective data analysis and statistical analysis methods that are essential for a wide range of fields, pursuits, and endeavors throughout the scientific community. His work has also proven exceptionally useful for leveraging social media data analytics into the improvement of disease progression and severity, including a study regarding the impact of influenza on public health.

Besides that, we also included 6 recommendation letters contributed by other experts in the field. These letters advocated for the approval of our client’s NIW petition and they reiterated the significance of his work to the United States. According to one of these recommenders: “His work is also invaluable for the examination of large datasets related to human genetics and disease risk. In short, if the U.S. aims to maintain its place as a global leader in the development of innovative medical solutions and the provision of top-quality clinical care, then it can ill-afford to lose such a talented scientific mind as [client].”

We join our client as he celebrates the approval of his NIW petition and we thank him for retaining us to help him with his I-485 application.

On March 24th, 2020, we received another NIW (National Interest Waiver) approval for a Researcher in the Field of Molecular Biology (Approval Notice).

General Field: Molecular Biology

Position at the Time of Case Filing: Researcher

Country of Origin: South East Asia (SEA)

State of Residence at the Time of Filing: New York

Approval Notice Date: March 24th, 2020

Processing Time: 8 months, 28 days

Case Summary:

North America Immigration Law Group (NAILG) has successfully attained over 16,000 I-140 immigration petitions. Our sterling reputation as a law firm that offers customized I-140 petitions and unprecedented insight into how the USCIS adjudicates cases are reasons why clients from all over the world seek our help for their green cards. In this case, a researcher from South East Asia hired us to help him with the first step in the green card process: filing an I-140 petition under the EB-2 NIW (National Interest Waiver) category.

Based on his research background and professional achievements, we determined that we would focus on his publication record, citation count, and peer review experience. At the time of filing, these numbers stood at 2 journal articles and 8 citations. We also included his specialized research which focuses on chromosomal techniques and viral infections. We emphasized that his research in this field is of great importance because it further advances understanding of serious and common viral infections prevalent throughout the world. These infections are often associated with the development of other grave diseases such as cancer and neurological disorders. All these factors helped our client to secure NIW approval, despite the lower citation count.

Further corroboration of the significance of his research was provided through 5 letters of recommendation volunteered by distinguished experts and researchers. One of these recommenders stated that “More common in the United States and throughout the globe, nearly 44 million people were reported to have Alzheimer’s or some related form of dementia worldwide in 2017. Through his research in yeast model systems, [client] has provided us with a platform for further protein dissection and the development of drugs and targeted therapeutics for these serious and debilitating diseases.”

Although we presented a strong case to the USCIS, our client’s petition was issued a Request For Evidence (RFE). With our experience of securing over 16,000 I-140 approvals, we put together a solid response which eventually led to the case approval after 8 months and 28 days. We congratulate our client on overcoming this great hurdle, and we wish him the best as he continues to carry out impactful research in the United States.

On February 19th, 2019, we received another EB-2 NIW (National Interest Waiver) approval for an Assistant Professor in the Field of Higher Education. (Approval Notice).

General Field: Higher Education

Position at the Time of Case Filing: Assistant Professor

Country of Origin: China

State of Residence at the Time of Filing: Illinois

Approval Notice Date: February 19th, 2019

Processing Time: 6 months, 23 days

Case Summary:

A Chinese assistant professor in the field of higher education has retained North America Immigration Law Group (wegreened.com) to submit a NIW (National Interest Waiver) petition on her behalf. While collecting relevant documentation, our team collaborated with our client closely with efficient and targeted communication which specifically address our client’s concerns towards the NIW preparation process. With our help, her petition was approved in less than 7 months.

Our client holds a PhD degree in higher education administration, with a focus on the impact of state policies and institutional initiatives on educational equity, which examines and bolsters the contributions of the community college system to broad education goals in the US. At the time we filed her case, she has judged the works of her peers for 23 times, and has published 8 peer-reviewed journal articles (6 of them first-authored) accumulating 9 citations. Her research has yielded invaluable insights about postsecondary education in the United States broadly, as she worked on several research projects to identify and empirically evaluate the best practices and programs implemented in community colleges, which has already won wide acclaim in the field.

In addition to discussing the importance of her research in higher education that holds significant implications for equity and opportunity in the American educational system, national economy and workforce, we have also included 6 letters of recommendation signed by prominent experts in the field to attest her contribution. This is how one of the recommenders described our client and her work, “This research has therefore identified a major flaw in the performance-based funding approach, and [client]’s work showed that performance-based funding, while having its benefits, also creates a situation in which efficiency and productivity are emphasized in a way that overlooks equity, access, and student choice (…) She has filled a gap in the literature and has given policymakers important information to fuel additional efforts to champion equity in education.”

We are pleased that our efforts paved the way for her NIW petition approval. We congratulate our client for completing this significant first step in the green card process, and we look forward to assisting her and her dependent(s) with the final step of the green card process (filing an I-485 application) when their EB2 priority date becomes current.

General Field: Industrial Design

Position at the Time of Case Filing: Product Designer and Developer

Country of Origin: China

State of Residence at the Time of Filing: North Carolina

Approval Notice Date: January 23rd, 2019

Processing Time: 7 months, 9 days

Case Summary:

With an M.S. in industrial design and many years of experience in outdoor product designing, our client – a product designer and developer from China, is not a regular scholar with publications, citations, and paper review experience. However, after carefully evaluating his various implementations and extensive credentials, we believe that he is a good fit for EB-2 NIW (National Interest Waiver).

In order to prove the national importance of our client’s work, in the petition letter we have listed his noteworthy accomplishments in diverse realms, such as healthcare and consumer products. We discussed about the innovative nature of his granted patent in details, and illustrated how his designs substantially improved the industries and yielded significant economic gains. His fellow experts in the field also provided additional insight into the merits of his endeavors: “In order for the US to maintain its leading role in this sector as other nations experience rapid growth, it is necessary to attract and retain workers with both proven success records and the skills needed to compete in a globalized economy. [Client] fulfills both these requirements, as shown by his achievements in both China and the US. He has distinguished himself as one of the most accomplished and capable designers in the field, and I am firmly of the opinion that it would be prudent for the US to allow him to remain in the country”.

After 7 months and 9 days of deliberation, the USCIS approved our client’s NIW petition. We are pleased that our hard work paid off. With our impressive success rate of over 12,000 case approvals, there is no surprise that we have once again helped our client achieve a successful I-140 petition. We congratulate our client for overcoming this challenge in the green card process, and we thank him for choosing us to represent his I-140 NIW case.

Client’s Testimonial:

“I am very happy that we could make it together since there are fewer cases in art in comparison with other fields and I would like to share this success with other potential applicants as well. […] to me instead of finding other attorneys who are more reputations in art, I decided to choose you because your team were/are very communicative with the clients and you had/have very good understanding about the financial difficulties that we had faced. I will recommend you to all my friends for sure!”

On November 8th, 2018, we received another EB-1A (Alien of Extraordinary Ability) approval for an Environmental Artist in the Field of Environmental Art (Approval Notice).

General Field: Environmental Art

Position at the Time of Case Filing: Environmental Artist

Country of Origin: Iran

State of Residence at the Time of Filing: Oregon

Approval Notice Date: November 8th, 2018

Processing Time: 3 months, 5 days (Premium Processing Requested)

Case Summary:

Three months after North America Immigration Law Group (NAILG) filed an EB-1A (Alien of Extraordinary Ability) petition for an Iranian environmental artist, the USCIS granted her case approval. An EB-1A petition must show how a foreign individual has sustained national or international acclaim and is considered one of the top experts in the field, therefore meriting the approval of the green card. We believe that our highly detailed EB1A petition and unprecedented insight into USCIS adjudication trends played a crucial role in case approval.

In comparison with petitioners in the scientific fields, whereas journal publication and citation count are common to demonstrate one’s achievements, regarding this specific case, our team has successfully garnered abundant evidence to substantiate her extraordinary ability.

Our client holds a Bachelor degree in sculpture and has made numerous contribution in the field of environmental art, with artworks particularly focused on endangered wildlife, conservation, and environmental activism and education. Her strong background in painting, writing, photography, illustration, and sculpture has allowed her works to be particularly original, and resulted in further ventures such as social projects, exhibitions, and fundraising.

We focused on the results of her work- her most prominent achievements includes 27 solo and group exhibitions she curated and the two book publications. In addition, her work has been highly influential within the artistic community, and this can be confirmed by the 10 of media coverage she received in the US and worldwide. In the petition letter, our team have also clearly list the sales and market share of those media to prove that these media meet mainstream media standards. The evidence our team submitted emphasizes her work as persuasive towards education, the art industry, and increasing social awareness, supplemented with expert opinion and testimonial letters, all indicated the significant impact that her work has had on the field.

With our rigorous methods of customizing our client’s petition and years of experience, we were able to build a convincing and strong petition for our client. Although USCIS issued an RFE, our team successfully responded with all the needed documents in an efficient manner. We are glad to list her case among our 10,000 success stories, and we wish her best in her future career pursuit.

On September 13th, 2018, we received another EB-1A (Alien of Extraordinary Ability) approval for a Director in the Field of Finance (Approval Notice).

General Field: Finance

Position at the Time of Case Filing: Director

Country of Origin: China

State of Residence at the Time of Filing: Pennsylvania

Approval Notice Date: September 13th, 2018

Processing Time: 2 months and 2 days (Premium Processing Requested)

Case Summary:

Just 2 months and 2 days after North America Immigration Law group (NAILG) filed a customized EB-1A (Alien of Extraordinary Ability) petition for a finance company director from China, the USCIS approved her case. We believe that our highly detailed EB1A petition and unprecedented insight into USCIS adjudication trends played a crucial role in case approval.

Our legal strategy involved focusing on our client’s contributions to the fields of finance and business. Unlike cases that involve researchers and other experts working in the scientific arena, we did not focus on citations or publications. In this case, we listed our client’s leading role in the field of finance, prizes and awards she had received in recognition of her excellence in the field, and her major business contributions. One of our client’s most prominent accomplishments involved the founding of two major finance companies which benefited rural areas in China. These companies helped numerous residents secure greater economic prosperity and created business opportunities on a local level.

Further, our client received outstanding entrepreneurship awards and was also named one of the Top 100 Outstanding Female Entrepreneurs in China. Such high-profile recognition from well-known industry institutions made it abundantly clear that our client’s work is of the highest quality and of significant important to the field of finance. Furthermore, our client had made multiple appearances in published media articles, both national and international, further proving her successful work in the field of finance.

To support her I-140 EB1A petition, we incorporated 6 recommendation letters volunteered by other industry experts. One of these recommenders stated, “[Client] is providing high-end investment advice and assistance…, providing international entrepreneurs and investors with the knowledge they need to succeed. […]This affords [Client] a high degree of financial security and an established customer base that together virtually guarantee the achievement of her business goals.”

Along with extensive documentation, we submitted a petition that demonstrated that our client had risen to the very top of her field of endeavor and had sustained national and international acclaim for her achievements. Although our client had a strong case, the USCIS issued a Request for Evidence (RFE), to which we promptly responded. We successfully dealt with all doubts about our client’s qualifications, and we are glad to list her case among our 10,000 success stories. We congratulate her on this win and thank her for retaining our Immigrant Visa Processing (IV Processing) services. “Many thanks for your email.”

On April 29th, 2017, we received another EB-2 NIW (National Interest Waiver) approval for a Petitioner in the Field of Pharmacology (Approval Notice).

General Field: Pharmacology

Country of Origin: Iran

Service Center: Nebraska Service Center (NSC)

State of Residence at the Time of Filing: Outside the US

Approval Notice Date: April 29th, 2017

Processing Time: 13 months, 4 days

Case Summary:

Based in Iran, our client has extensive experience in the field of pharmacology and is undoubtedly an outstanding researcher. Her consistent contributions to the field made her a suitable candidate for EB-2 NIW (National Interest Waiver), and after determining that we could help her build a solid case, we gathered an array of evidence to support the petition.

Collecting relevant information:

In a nutshell, we had to prove that our client’s work is of national interest and intrinsically valuable to the United States. We proved this by detailing her 6 publications and the 6 times they were cited. Further, we detailed our client’s work on neuronal network communication and demonstrated that her research results have directly contributed to drug development and healthcare. Additionally, we established that her neurodegenerative disease research efforts are contributing to the United States’ medical research community and healthcare system.

As with all our clients, we advised her on the process of selecting recommenders and obtaining their testimonials. These testimonials supported the approval of our client’s NIW petition and contained strong statements such as these:

  • “As her research has already proven beneficial, I am sure that she will continue to provide unique advantages to the medical community through her hard work.”
  • “I am positive that she will only continue to provide scientific advancement to the nation.”
  • “As one of the most talented researchers in her field, it would only serve as a detriment to the United States to lose her research.”

Despite the long wait (13 months and 4 days), we are pleased that our client finally obtained NIW petition approval. As she does not reside in the US, she cannot file an I-485 application to adjust her status for permanent residence. Instead, she must undergo Immigrant Visa Processing (IVP). Since there is no US embassy or consulate in Iran, our client must undergo IVP at one of the neighboring countries. We thank her for retaining our IVP services, and we look forward to helping her obtain a green card.

Client’s Testimonial:

“Thanks so much for the good news and I appreciate all the efforts and hard work you put out to help my case succeed.”

On July 7th, 2017, we received another EB-2 NIW (National Interest Waiver) approval for a Ph.D. Candidate in the Field of Electrical Engineering (Approval Notice).

General Field: Electrical Engineering

Position at the Time of Case Filing: Ph.D. Candidate

Country of Origin: Vietnam

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: New Jersey

Approval Notice Date: July 7th, 2017

Processing Time: 2 months, 20 days

Case Summary:

Just 2 months and 20 days after North America Immigration Law Group (NAILG) filed an EB-2 NIW (National Interest Waiver) petition on behalf of a doctoral candidate from Vietnam, he received notification of case approval. As it usually takes the USCIS between 4-9 months to take action on I-140 petitions, we are extremely pleased at the rapid timeline, and we congratulate our client for obtaining the national interest waiver based on the new Matter of Dhanasar framework. To learn more about these guidelines that were recently implemented on December 27th, 2016, please visit http://www.wegreened.com/niw/.

Our overall goal was to prove to the USCIS that our client is an asset to the United States. We went about this by collecting a wealth of information related to his work in the field of electrical engineering. From his M.S.in Electrical Engineering to his publication record (2 first-authored peer-reviewed conference articles, 1 accepted first-authored peer-reviewed conference article, and 1 thesis), we left no stone unturned when it came to detailing our client’s various achievements.0~10 citations

In a bid to further strengthen his NIW petition, we incorporated recommendation letters signed by other experts working in the field. These letters served as evidence that our client’s work is important not only to the field of electrical engineering, but to the US as a whole. This is a statement excerpted from one of these letters: “His [Client’s] research has been so exceptional and useful to the United States that it has been funded by government organizations…” Another recommender noted that “… [Client’s] service in this capacity demonstrates his importance to the engineering community.”

Thanks to our diligent efforts, the USCIS was convinced that our client’s findings on the development of signal processing methods and algorithms improve the performance and security of radar systems and wireless communications in the United States. We congratulate our client for obtaining the national interest waiver, and we thank him for retaining us to file I-485 applications for him and his dependent. We look forward to helping them obtain their green cards and in the meantime, we wish our client the best as he continues to progress the field of electrical engineering.

Client’s Testimonial:

“Thank you. I also received approval of my I-140 in the mail.”

On March 11th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Research Associate in the Field of Microbiology (Approval Notice).

General Field: Microbiology

Position at the Time of Case Filing: Research Associate

Country of Origin: Nigeria

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Texas

Approval Notice Date: March 11th, 2016

Processing Time: 10 months, 17 days

Case Summary:

With an M.Sc. in Health Promotion and Public Health and many years of experience working in the field of microbiology, our client (a research associate from Nigeria) qualified to file her I-140 petition under the EB-2 NIW (National Interest Waiver) visa category. North America Immigration Law Group (WeGreened.com) helped her put together a strong petition packet that ultimately convinced the USCIS to approve her NIW petition. Because our client opted to file her I-485 application (final step in green card proceedings) while her petition was pending approval, she received a green card approval a month after she received her NIW approval.

EB-2 NIW Petition Packet:

When we filed her case, our client’s 2 publications had collected 3 citations. This proved the value of her work to other researchers in the field of microbiology where the amount of scholarship activity is relatively low. With a focus on biocorrosion, or the involvement of microorganisms in the corrosion process, our client’s work is essential to countries like the United States, where corrosion contributes to high industry expenditure, and maintaining low environmental impact is a major concern. We demonstrated that not only is our client an asset to the nation, but that only a handful of other researchers with similar qualifications can mirror her research success.

Third-Party Support:

To further strengthen our NIW presentation, we prompted our client to touch base with other influential researchers in her field. We needed her to persuade them to contribute recommendation letters supporting our claim that she should continue her research in the United States. Our client did not disappoint, and returned with six strong testimonials, one of which described her work as beneficial to the petroleum industry: “I must also stress that her work have public health and environmental benefits. Chemical leakages due to corroded pipelines and drilling gear are a public health hazard, and have been documented in the Permian Basin to have contaminated tap water sources. The reduction of corrosion decreases the incidence of chemical leakages, allowing water quality to improve.”

Agreeable Results:

From the date we submitted our client’s EB-2 NIW petition to the date she received her green card, our client patiently waited close to a year (her I-485 application was filed while her I-140 petition was pending approval). We congratulate our client and her partner for becoming American permanent residents, and we wish her well as she continues to investigate the field of microbiology.

Client’s Testimonial:

“Thanks.”

On February 26th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a User Experience Research Associate in the Field of Design Science (Approval Notice).

General Field: Design Science

Position at the Time of Case Filing: User Experience Research Associate

Country of Origin: Iran

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Virginia

Approval Notice Date: February 26th, 2016

Processing Time: 7 months, 3 days

Case Summary:

North America Immigration Law Group (WeGreened.com) filed an EB-2 NIW (National Interest Waiver) petition on behalf of a talented research associate engaged in design science—a relatively young field motivated by a desire to understand how people experience and make decisions related to the artifacts and systems that are embedded in our environments. Our client’s work encompasses user experience research that evaluates how users interact with systems, and how the built environment would encourage people to change their behavior. By understanding our client’s research efforts, we were able to demonstrate to the USCIS that her findings benefit both businesses and consumers in the United States, in the sense that they enhance citizen experience nationwide.

Our client’s background in design science and industrial design stemmed from the several years that she spent obtaining her Master of Arts and doctorate degree. In addition to that, her experience in the industry honed her skills, molding her to become one of the most respected researchers in her field.

Our client’s research has led to three published conference papers, a myriad of conference presentations, and several invited talks mostly focused on designing the future with intent and causing positive social impact through design of the built environment. These professional accomplishments had gathered four citations at the time of filing and served as evidence that her findings are essential to other design scientists.

To strengthen our EB-2 NIW petition dossier, we counseled our client to contact other experts in her field and ask for recommendation letters. Six experts agreed, one of whom wrote, “We have similar research interests, and I consider [Client’s] work in the area of design science to be incredibly forward thinking. In fact, I see her work as so integral to this field that without her continued input and insight, further advancement would be hampered, particularly in relation to how we use and apply interdisciplinary research product design in order to change behavior.”

Another expert stated, “As an emerging discipline that is proving to be incredibly important for fostering such positive outcomes as increased sustainability, supporting the work of gifted innovators like [Client] is critical.”

Texas Service Center spent 7 months and 3 days adjudicating this case before granting their approval. Our client recently opted to file her I-485 application (final step in green card proceedings) using our complimentary D.I.Y. packet. We wish her the best with her application, and thank her for selecting our firm to represent her NIW case.
