Case Summary:

An EB-2 NIW (National Interest Waiver) petition approval was granted to a software developer based in Wisconsin in the field of music technology. When our client approached us, we started investigating his education and research experience before countersigning the client-attorney relationship. With our hands-on experience in handling many I-140 petitions, we were certain that we could lead him to achieve the NIW success after a thorough assessment of his credentials.

Our main objective was to prepare a persuasive case on his behalf, displaying his extensive skill set mostly gathered through his robust educational background and a number of advanced research positions which enabled him to be a leader in his field. Here are some of the important details we laid out in our client’s petition packet to be presented to the USCIS:

1) We noted that our client, holder of a Ph.D. in music technology, focused on applying computer technology to music related areas. To evaluate his research accurately, it was imperative for us to first understand the unique conventions in the interdisciplinary field, and we deduced that his proposed work is of great importance because it is advancing technology that has immediate real-world applications. His tangible advancements are innovative on computational processing, machine learning, and statistical methodologies.

2) We also detailed the 22 citations accumulated from the four peer-reviewed conference articles (two of them first-authored) he published in the journals which are of the highest repute. Several internationally distributed conference proceedings have also accepted and published his research, and getting published within conference proceedings of such scientific merit, it is evident that he is a leading researcher making notable contributions to his chosen field.

3) In further evidence of his professed expertise in the field, we observed that he is also active in the scientific community as a peer reviewer for highly acclaimed journals and books, and he has conducted at least 20 reviews to date. Only scholars with prominence among the highest in the field are invited to review the work of others. Thus, this confirms the ways in which our client’s influence has surpassed that of many of his peers.

4) Going forward, we highlighted one of our client’s recommenders’ statement, corroborating to the fact that our client’s research on generation of music performances is a key tool for production music creators, as well as musician’s writ large, and his models, are contributing to this important and profitable industry because producing music is both a critical resource for content producers in the U.S., as well as a highly profitable revenue stream for businesses.

In total, we added five recommendation letters acquired by our client as he managed to reach out to other well-known experts in the field. They were obliged to support our client’s research on improving musical creating tools which clearly is in the national interest of the U.S. The following excerpts have been extracted from two of the submitted letters:

“The field of music technology is the key scientific link connecting music and computers, particularly by transforming traditional music into data. [Client’s] innovative research is thus progressing the field, positively influencing the research of his peers, providing new pathways to connect music and technology, and improving many aspects of prior system designs. Consequently, his ongoing endeavors in the must be afforded the opportunity to continue.”

“[Client’s] developed application is downloadable from the Apple App Store and Google Play and has hundreds of thousands of users. We are using his application to create content for our education app that helps people learn music. In providing us with an invaluable tool for our business, he has demonstrated the concrete real-world value of his research.”

Fortunately, we were able to persuade USCIS of the distinct instances of citation, implementation, and commercialization of our client’s work, highlighting his ability to direct some of the most pressing challenges within the field of music technology. Therefore, our client received his NIW approval within 8 months and 7 days. We thank our client for choosing and trusting North America Immigration Law Group for representing his case.
