On September 9th, 2021, we received another EB-2 NIW (National Interest Waiver) approval for an Associate Professor in the Field of Food Safety (Approval Notice).

General Field: Food Safety

Position at the Time of Case Filing: Associate Professor

Country of Origin: Nigeria

Country of Residence at the Time of Filing: Nigeria

Approval Notice Date: September 9th, 2021

Processing Time: 10 months, 14 days

Case Summary:

We at North America Immigration Law Group, take utmost care in conducting a thorough background check of every client who approaches us for helping them with their immigration petition to USCIS. So, when an associate professor in the field of food safety approached us, we made certain that he received the best legal aid for his I-140 NIW (National Interest Waiver) petition. We presented his exceptional professional background and unparalleled experience important to his current and future work at the USCIS.

After reviewing his credentials, we found that our client has accommodated an impressive record of success. He received Ph.D. in food safety veterinary epidemiology, and his research has resulted in 36 peer-reviewed journal articles (12 of them first-authored), 1 book chapter, and 1 book. Furthermore, his publications have been cited a total of 506 times according to Google Scholar, thereby signifying that these publications are widely acknowledged and counted upon in the field of his expertise.

Additionally, our client’s research related to food and water-borne health risks associated with contaminants, microbial residues, and zoonoses has great substantial merit and national importance. His research is relevant to agriculture, disease prevention, and food safety as a whole, and has even worked on projects related to water quality, which is important because of the importance of drinking water and the deaths that occur due to poor water quality and contamination. His proposed endeavor thus is to devise novel bioinformatics and chemical risk assessment techniques to identify and develop solutions to address such major health issues around the world.

Apart from his achievements, out of the four recommendation letters that he obtained from his fellow experts in the field, one of the recommenders had the following to say about his work:

“[Client’s] work in food safety is considered beneficial to the United States. The CDC states that about 3000 Americans die from diseases caused by food poisoning every year, with tens of thousands more being hospitalized as a result of such illnesses. [Client’s] development of strategies to screen for both dangerous bacteria and chemical residue in food products, as well as his ability to identify the causes behind such phenomena, make him a valuable asset for reducing these threats to the health of the American population.”

The evidence in the aggregate thus demonstrates that our client’s work and his ongoing efforts are key to preventing epidemics, making his work of clear benefit. His commitment to inspecting food and water for dangerous bacterial strains and closely analyzing these samples confirms that the United States has a vested interest in maintaining our client’s services in his field of food safety.

We are certain that he is more than capable of furthering his knowledge base in the chosen field and continuing his work in the United States of America. Since this client lives outside of the United States, he will now begin Immigrant Visa Processing as the final step toward his green card. We thus wish him the very best in his life and success in all the endeavors that he takes up soon.

Client’s Testimonial:

“Very happy to work with you! Thank you!”

On April 22nd, 2021 and June 22nd, 2021, we received another EB2-NIW (National Interest Waiver) and O1-A (Individuals with Extraordinary Ability or Achievement) approvals for a Director of Client Services in the Field of Food Science (Approval Notice).

General Field: Food Science

Position at the Time of Case Filing: Director of Client Services

Country of Origin: India

State of Residence at the Time of Filing: Illinois

Approval Notice Date: April 22nd, 2021 (NIW) and June 22nd, 2021 (O1A)

Processing Time: 7 months (NIW), and 14 days (O1A) (Premium Processing Requested)

Case Summary:

When our client, a director of client services from India contacted us to help her file an EB-2 NIW (National Interest Waiver) petition to represent her case, we began analyzing her credentials and discerned that she held a Ph.D. in food science and many years of substantial experience researching the same field. We were certain of her noteworthy knowledge in the field and that she deserved the national interest waiver. To lead her to the NIW success, we needed to build a powerful case on her behalf. Gladly, she received her NIW approval exactly 7 months and 2 days after we filed the petition.

After the NIW success, our client retained the services of North America Immigration Law Group for another petition filing under the O1A (Individuals with Extraordinary Ability or Achievement) visa category. With over 17,000 approved cases, we have unprecedented insight in articulating more than one petition for our clients. It is not surprising to file more than one petition as petitioners do so to get closer to green card success. In this case, we were sure of her O1A success, thus, we advised her to send the required details for the O1A case preparation. Once we compiled all the relevant information, we customized her I-129 O1A petition and detailed the following in her petition presentation:

1) We reviewed her research focusing on analyzing consumer behaviors and responses to develop advanced consumer behavior prediction techniques, and how it addresses some of our nation’s most pressing issues in understanding product development and innovation in the food industry. This work has had an enormous impact on the United States food industry and the agricultural sector; thus, her work has been majorly significant and of the utmost importance due to the advanced information, it provides for other experts in the field.

2) We also noted her significant publication framework, the 13 peer-reviewed journal articles which altogether garnered 240 citations from prestigious national and international institutions, signifying that her work has a great influence on other scholars in the field of food science. Additionally, we recorded that she has already conducted 18 reviews for the most distinguishing journals, and only because of her extraordinary expertise in the field, she has been regularly invited to conduct peer reviews.

3) We highlighted how she has been offered employment in a notable organization where she seeks to continue her employment in the field of food science. Moreover, we added four written advisory opinions to support her case further. Our client obtained these letters from other leading researchers from top universities and research groups from the United States and abroad confirming her as a researcher of extraordinary ability in her specialized field.

“The Food and Agriculture Organization of the United Nation promotes food labeling as a useful tool for protecting consumer health through food safety and nutrition… [Client] is an individual who conducts cutting-edge research in the food science field on predicting and understanding how consumers interact with food labels. Her research is crucial to improving the overall quality and effectiveness of food labels, thereby providing tangible benefits to global food industries, particularly at a time when consumer reliance on food labels is constantly increasing.”

Therefore, we were able to convince USCIS that our client is a top-notch scholar in food science research and she must be fully supported as it is crucial that she be allowed to continue working in the United States. Thanks to the premium processing upgrade, our client received her O1A approval in just 14 days. We are truly happy to help our client attain both the petition approvals 2 months apart. We thank her for choosing us for her I-140 and I-129 application and allowing us to be part of this success story.

General Field: Food Science

Position at the Time of Case Filing: Ph.D. Student

Country of Origin: Iran

State of Residence at the Time of Filing: Missouri

Approval Notice Date: April 1st, 2020

Processing Time: 5 months, 16 days

Case Summary:

A recent client of ours was described as “A researcher with [client’s] background and documented accomplishments serves the national healthcare agenda of the United States, and she is clearly regarded as an authority in her discipline.”

The quote above is excerpted from a recommendation letter contributed by a well-known chief executive officer. He was not alone in this strong show of support for our client and was joined by five other expert researchers in the field of food science, all of whom signed recommendation letters. These letters were incorporated into our client’s EB-2 NIW (National Interest Waiver) petition dossier which North America Immigration Law Group (WeGreened.com) submitted to the USCIS on her behalf.

What else did the petition contain?

Besides recommendation letters, our client’s comprehensive EB-2 NIW petition packet was composed of details of her research on the development of novel strategies to improve food safety. We demonstrated to the USCIS that our client’s work in her area is of great importance because it significantly improves strategies to preserve perishable foods using natural, environmentally friendly compounds. Her cutting-edge research also drives economic growth in the global pharmaceutical market. With an M.Sc. in food science and technology and a myriad of professional achievements under her belt, our client is undoubtedly a leading light in the field. Her work has resulted in the publication of 5 peer-reviewed journal articles (3 of them first-authored), all of which had amassed 32 citations when we filed the case. Our client is also active in the scientific community as a peer reviewer for highly acclaimed journals and has already conducted at least 3 reviews.

Filing I-485 applications while the I-140 is pending approval:

The USCIS spent 5 months and 16 days adjudicating our client’s EB-2 NIW petition before granting the approval. A little over 3 months later, our client received news that her I-485 application had been approved. As the final step in the green card process, an approved I-485 means that our client is now an official U.S. permanent resident. We congratulate our client for securing the NIW petition and green card approval, and we wish her the very best as she embarks on her exciting new journey as an American permanent resident.

Client’s Testimonial:

“I really appreciate your help for I-140 case.”

On March 16th, 2020, we received another NIW (National Interest Waiver) approval for a Dairy Nutritionist in the Field of Dairy Science (Approval Notice).

General Field: Dairy science

Position at the Time of Case Filing: Dairy Nutritionist

Country of Origin: Iran

State of Residence at the Time of Filing: California

Approval Notice Date: March 16th, 2020

Processing Time: 7 months, 15 days

Case Summary:

Just 7.5 months after the North America Immigration Law Group (NAILG) filed a customized EB-2 NIW (National Interest Waiver) petition for a dairy nutritionist from Iran, USCIS granted the approval of this I-140 petition. With our impressive success rate of over 16,000 approvals, there is no surprise that we have again helped our client achieve a successful I-140.

Our client holds a PhD in animal sciences with an extensive experience in the field of dairy science. His various achievements include 5 peer-reviewed journal articles (2 of them first-authored), and 28 citations from researchers around the world. The subjective evidence all proved that our client is an asset to the United States, and he should be allowed to carry out his research in the country.

In order to stand out from the thousands of other NIW petitions sent to the USCIS, we also gathered a wealth of practical information pertaining to our client’s research on ruminant nutrition. One of his most impressive achievement is that he has presented data aiding in the reduction of liver abscesses in feedlot cattle and identifying metabolites associated with metabolic disorders in dairy cattle transitioning from gestation to lactation. By extension, his work greatly benefits not just the dairy and beef sectors, but the global agriculture industry.

Not just that, we also included recommendation letters signed by a handful of other well-known scientists, and one of the letters contained this convincing statement: “With these figures in mind, there is no question that the dairy industry plays a vital economic role in addition to providing food and nutritional needs of people throughout the United States. Through his research, [client] has obtained results that facilitate the use of RP-Met to increase milk production on dairy farms. His results are thus beneficial to the profits of such farms, which emphasizes the economic impact of his findings.”

We thank our client for choosing us to represent his NIW petition. Our client now eagerly awaits a decision on his I-485 application, and we believe that our client deserves the US permanent residency because he has made critical contributions to the field of dairy science.

“Thank you so much for helping me go through this process! I do appreciate!”

On January 7th, 2020, we received another EB-1A (Alien of Extraordinary Ability) approval for a Researcher in the Field of Nutritional Science (Approval Notice).

General Field: Nutritional Science

Position at the Time of Case Filing: Researcher

Country of Origin: China

State of Residence at the Time of Filing: Massachusetts

Approval Notice Date: January 7th, 2020

Processing Time: 13 months, 4 days

Case Summary:

Texas Service Center (TSC) found our client, a Chinese researcher, to be a deserving candidate for EB-1A (Alien of Extraordinary Ability). The fact that her work aids the United States in understanding conditions such as atherosclerosis, undoubtedly paved the way for EB-1A approval. Before establishing an attorney-client relationship, North America Immigration Law Group (NAILG) carefully studied our client’s credentials to determine their veracity. Once we were assured that her credentials qualified her for EB-1A, we counter-signed the retainer agreement and got to work building her case. Here are some of the key points we focused on:

  • Research Details: In order to prove that our client’s work is important to the United States, we first had to account for and understand her research focus. Largely thanks to the comprehensive research summary which she provided us, we determined that her work is focused on nanomedicine. We established that her findings are essential to the nation as it deals with applications such as diagnosing and treating atherosclerosis.
  • Citation Count and Publication: Our client’s extensive experience in the field of medicinal chemistry had led to the publication of 10 peer-reviewed scientific articles and 1 book chapter, all of which had been cited a total of 341 times when we filed the case.
  • Peer Review Service: To further illustrate our client’s leadership role in the field, we noted the 13 times she had conducted peer review for various high-impact scientific journals.
  • Additional Evidence: Like any legal case, we had to present evidence to support our argument that our client deserved to get one step closer to a green card. We did this by urging our client to collect recommendation letters from a handful of her peers. These letters confirmed the value of our client’s work to the US and contained statements such as: “Atherosclerosis is the number one cause of death and disability in the developed world. However, it has also increased in commonness all over the world as modern Western diet patterns promote the increased propensity towards inflammation and cholesterol buildup in the arteries… [Client’s] research provides important advancements in the early detection of atherosclerotic lesions, providing her fellow researchers with the tools needed to take on epidemic levels of advanced atherosclerosis progression in the Western world.” The customized EB-1A petition packet which we arranged for our client also included table and figures to indicate that our client’s publications have been cited at a much higher rate than those of other researchers in the field, distinguishing her from her peers.

Despite our best efforts, the USCIS issued a Request for Evidence (RFE) not long after we filed the petition. Our team efficiently put together a strong response to the RFE, which subsequently led to case approval. We congratulate our client for securing an EB-1A petition approval and we thank her for choosing to work with our law firm. It was a pleasure helping her with the first step of the green card process and we wish her the best with her continued research in the United States.

Client’s Testimonial:

“Thank you for your notice. I am very happy we get to the final success.”

On July 8th, 2017, we received another EB-1A (Alien of Extraordinary Ability) approval for a Postdoctoral Associate in the Field of Nutrition (Approval Notice).

General Field: Nutrition

Position at the Time of Case Filing: Postdoctoral Associate

Country of Origin: China

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Massachusetts

Approval Notice Date: July 8th, 2017

Processing Time: 101 Days (Premium Processing Requested)

Case Summary:

A postdoctoral associate from China hired North America Immigration Law Group (NAILG) when she decided that she wanted to become an American permanent resident. After carefully going through her credentials, we determined that it was possible to help her accomplish her goal. We started off by building and filing the I-140 petition (the first step in the green card process). In this case, it was filed under EB-1A (Alien of Extraordinary Ability).

To prove that our client possesses extraordinary ability in the field of nutrition we had to gather as much information as we could on her various achievements. For instance, we listed the 17 peer-reviewed scientific articles, one Chinese patent, and two book chapters in her name. We also noted the 25 times she conducted peer reviews for scientific journals and the 112 times her work was cited by other researchers. Leaving no stone unturned, we also discussed her work on nutrition and food science for age-related health conditions, such as obesity, dyslipidemia, and Alzheimer’s disease.

To further strengthen our client’s petition, we encouraged her to reach out to several of her peers and ask for recommendation letters. We made sure that her recommenders were expert nutritionists and were familiar with her research. The six letters that our client obtained contained strong statements such as this one: “In my estimation, there is no replacement for [Client] in the scientific community. Her skills in bioinformatics, nutrigenetics, and epidemiology set her apart from the majority of her peers, making her uniquely qualified to pursue her current research endeavors.” We have no doubt that these letters played an important role in petition approval.

Despite submitting a strong EB1A case to the USCIS, the petition was issued a Request for Evidence (RFE). Our team sprang into action and put together a convincing response to the RFE, which eventually led to EB1A petition approval. We congratulate our client for overcoming this significant hurdle in the green card process. Furthermore, she chose to file her I-485 application (the second and last step in the green card process) while her EB1A was pending approval, and we are currently waiting for the USCIS to take action on it. In the meantime, we wish our client the best as she continues to progress the important field of nutrition.

On February 15th, 2017, we received another EB-1A (Alien of Extraordinary Ability) approval for a Postdoctoral Research Fellow in the Field of Nutrition Medicine (Approval Notice).

General Field: Nutrition Medicine

Position at the Time of Case Filing: Postdoctoral Research Fellow

Country of Origin: China

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: Georgia

Approval Notice Date: February 15th, 2017

Processing Time: 14 days (Premium Processing requested)

Case Summary:

Within 14 days of filing an EB-1A (Alien of Extraordinary Ability) petition for a Chinese postdoctoral researcher in the field of nutrition medicine, North America Immigration Law Group (NAILG) received good news from the USCIS, marking a joyous moment for both our professional team as well as our client. This petition approval entailed hard work and we proved once again that our staff is endowed with the right talent and commitment to offer our clients an impressive standard of service.

Highlights of the EB-1A Petition Package:

We proved that the impact of our client’s research stretches far beyond the perimeter of the scientific community and positively impacts many aspects of daily life. A part of her research focuses on the pathophysiology of pediatric nonalcoholic fatty liver disease (NAFLD) to improve prevention and treatment strategies. It should be noted that she is particularly well-known for her investigation on the metabolic tolerance of dietary fructose in children.

Apart from highlighting our client’s significant breakthroughs in the field of nutrition medicine, we showcased her record of authorship in this discipline. Our client’s petition packet included data on the 9 peer-reviewed journal articles, 12 conference abstract articles, and 1 review she had authored at the time of filing. We also listed the 48 peer reviews she had conducted for high-impact scientific journals. Additionally, we noted her citation record, which quantified the current societal impact of her research: when we filed our client’s petition, her work had garnered 135 citations.

In order to further strengthen this EB-1A petition, we incorporated recommendation letters contributed by several industry experts. This is what one of our client’s recommenders had to say about her work: “With help from [Client’s] research, I was able to assemble a study demonstrating that reduction in dyslipidemia due to dietary changes led to improvement in the condition of the liver for NAFLD patients”.

Our sheer determination and high quality service helped our client get closer to green card success just two weeks from the date of filing. Thanks to Premium Processing (PP), the entire application process was expedited. We congratulate our client for surpassing the first milestone in the two-part green card process, and we are pleased to have her working with us again as she files I-485 applications for herself and her spouse.

Client’s Testimonial:

“Thank you again for your hard work and patience.”

On May 6th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for a Postdoctoral Researcher in the Field of Nutrition (Approval Notice).

General Field: Nutrition

Position at the Time of Case Filing: Postdoctoral Researcher

Country of Origin: China

Service Center: Texas Service Center (TSC)

State of Residence at the Time of Filing: North Carolina

Approval Notice Date: May 6th, 2016

Processing Time: 6 months, 15 days

Case Summary:

6.5 months after North America Immigration Law Group (WeGreened.com) filed an EB-2 NIW (National Interest Waiver) petition on behalf of a postdoctoral researcher from China, the USCIS approved her case. A little over a month after we received the approval notice, we filed I-485 applications for our client and her husband. This is the final step in the green card process and once approved, they will become American permanent residents.

What do the rules of cross-chargeability entail?

Although our client was born in China and has an approved EB-2 NIW petition, she was able to adjust her status for permanent residence without waiting several years for her priority date to become current. Other petitioners born in China with EB-2 NIW petitions that were approved around the same time have to wait several years for their priority dates to become current before they can embark on the last step of the green card process. The reason why our client skipped this step is because the rules of cross-chargeability applied to her. In a nutshell, she was able to file I-485 applications for herself and her spouse based on his current priority date. She was essentially charged to the numerical limitation set for her spouse’s country of birth: Taiwan. For more information on the rules of cross-chargeability, please refer to http://blog.wegreened.com/uncategorized/cross-chargeability/.

Building a strong case:

With a Ph.D. in Nutrition and extensive experience working in the same field, our client has amassed a wealth of knowledge that allows her to continuously attain successful research results that benefit the United States. Thanks to the comprehensive research summary that she provided us, we were able to conclude that her work on weight loss and inflammation contribute to an enhanced understanding of how the popular CLA supplement affects the human body. Additionally, her research efforts are contributing to the United States’ public health and economy in the form of savings from fewer cases of obesity. Furthermore, we noted our client’s 79 citations collected from her 8 published scientific articles. Based on all the information that we had gathered, we were able to prove to the USCIS that our client is an asset to the nation and that only a small handful of similarly qualified nutritionists can obtain such relevant research results. According to one of our client’s supporters (she rallied six in total and convinced them to sign recommendation letters), her “…contributions to nutrition and public health are unmatched and have had immeasurable impact on combatting obesity in the United States by way of developing our understanding of commonly-used dietary supplements.”

We congratulate our client for overcoming this significant hurdle in the complex green card process, and we join her as she awaits a positive outcome regarding her and her husband’s I-485 applications.

Just 11 days after North America Immigration Law Group (WeGreened.com) filed an EB-1A (Alien of Extraordinary Ability) petition on behalf of a Chinese postdoctoral fellow, the USCIS granted their approval. With a Ph.D. in Food Science, 10 peer-reviewed scientific articles and 21 presentations at national and international conferences to her name, our client has certainly established herself as a researcher who is well-armed with the skills needed to churn out impactful research results. We demonstrated that the field of food microbiology has seen significant advancements since our client started carrying out research focused on foodborne pathogen detection and antimicrobial resistance. Furthermore, we demonstrated that our client’s work is essential to the United States as it helps researchers and industries alike understand foodborne illnesses.

A significant portion of our client’s EB-1A petition packet was dedicated to recommendation letters which she obtained from other influential food microbiologists. These experts confirmed the value of our client’s work to the United States by signing off on testimonials such as this one: “When considering all that [Client] has accomplished so far, I can say with confidence that she is a stand-out individual among her peers in the field. [Client’s] research and scientific contributions have been original and applicable to current challenges in numerous industries of the United States, marking her as a pivotal contributor in food science. It is no overstatement to say that the scientific community of the United States would be put at a great disadvantage if she were not allowed to continue her research in the U.S.” Alongside these letters were supporting details such as the 119 citations gathered from her work and the 13 times she judged the work of her peers for several scientific journals.

We congratulate our client for obtaining an in-demand EB-1A petition approval and we wish her the best as she continues her important work in the field of food microbiology.
