On December 21st, 2017, we received another EB-1A (Alien of Extraordinary Ability) approval for a Research Associate in the Field of Learning Sciences (Approval Notice).

General Field: Learning Sciences

Position at the Time of Case Filing: Research Associate

Country of Origin: India

State of Residence at the Time of Filing: California

Approval Notice Date: December 21st, 2017

Processing Time: 10 Days (Premium Processing Requested)

Case Summary:

It only took the USCIS 10 days to determine that our client—a research associate from India—deserved to have his EB-1A (Alien of Extraordinary Ability) petition approved.

With a Doctor of Philosophy and a Master of Science, our client is undoubtedly armed with very specific skills needed to advance the field of learning sciences. As part of our services, we determined our client’s background, field of expertise, various achievements as well as strengths and skillsets, and came up with a unique strategy to secure EB1A petition approval.

As part of our customized legal strategy, we advised our client on the best timing to file his case. We also determined that our client qualified for EB1A based on the following three criteria:

(1) Original scientific, scholarly, artistic, or business-related contributions of major significance: We discussed our client’s design and development of a unique device for improving the cognitive, social, and learning skills of chronically ill, hospitalized patients. We convinced the USCIS that his work is exerting an enormous impact on healthcare, learning and behavior, and education technology.

(2) Authorship of scholarly articles in the field, in professional or major trade publications or other major media: We noted that our client’s work has resulted in at least 2 peer-reviewed conference articles – an extremely productive record compared to that of others in the shared field of endeavor.

(3) Receipt of lesser nationally or internationally recognized prizes or awards for excellence in the field of endeavor: We detailed the 3 national awards our client received for his work. These awards were from prestigious organizations and institutes and are known to be highly competitive.

(4) Evidence of material published about our client in major professional or trade publications or other major media: Our client was featured in various new articles by national and international media. Considering the widespread circulation of these media outlets, coverage is indicative of the importance of our client’s work.

Based on the wealth of information we gathered, we customized a detailed petition letter that highlighted our client’s extraordinary ability in the field. To back up our argument that our client’s work is beneficial to the US and that his EB1A petition should be approved, we also presented several recommendation letters as subjective evidence. These letters were contributed by other influential experts working in the field of learning sciences, one of whom noted the following: “With his broad influence in the field, [Client] exhibits qualities and research abilities that place him above almost every other researcher working in the learning science field.”

Our unique case strategy convinced the USCIS that our client is an asset to the United States, most notably when it comes to understanding how to effectively provide children (with chronic illnesses) creative outlets and learning opportunities while encouraging social interchange with others and improving patient health care by increasing physical activity.

Thanks to the effective methods employed by the team at North America Immigration Law Group (WeGreened.com), our client is now one step closer to obtaining a green card. With over 10,000 approvals in the bag, we undoubtedly have unprecedented insight how officers adjudicate cases. Furthermore, because of the high number of petitions our firm files, we have firsthand information regarding any changes the USCIS makes in adjudicating cases.

We thank our client for choosing us to represent both his EB1A petition and I-485 application, and we wish him the best as he continues to progress the field of learning sciences.

Case Summary:

With a Ph.D. in Biomedical Engineering and considerable experience conducting fieldwork, a postdoctoral research associate from India seemed like a good candidate for EB-1A (Alien of Extraordinary Ability). Nevertheless, we carefully went through his credentials to be sure that we could build a solid EB1A case for him. Once we determined that we could, we initiated an attorney-client relationship.

Determining what to focus on:

The many years that our client has spent progressing the field of biomedical engineering have led to various achievements. As part of our services, we narrowed them down and determined what to include in his petition packet. Amongst other things, we detailed his 8 peer-reviewed scientific articles, 4 published abstracts, one conference article, and two book chapters. We also noted the 97 times his work had been cited by other researchers as well as the 45 times he assessed the work of his peers.

Compiling important evidence:

Additional information such as our client’s doctoral degree, CV, and employment letter were also included in the petition packet. Furthermore, we incorporated 4 recommendation letters volunteered by other expert biomedical engineers, all of whom supported the approval of our client’s EB1A petition. As an example, this is what a couple of them noted in their letters:

“The loss of his work would have consequences that affect not only other scientists, but the medical community and public health as well. [Client] is a leading researcher in modern biomedical engineering research, and his efforts provide compelling evidence of his production.”

“He is certainly one of the most prominent and accomplished individuals working in this area, and the continued improvement of the biomedical engineering field is dependent upon his future research.”

Presenting a strong case:

Overall, we persuaded the USCIS that our client’s findings on combining engineering and molecular biology approaches to investigate the mechanisms of heart valve disease are important to the United States. Convinced that he has risen to the top of the field, they approved his EB1A petition. As the icing on the cake, our client received the good news that his I-485 application had also been approved, making him an official US permanent resident. We congratulate him for completing the green card journey and thank him for working with us.

Nearly 8 months after North America Immigration Law Group (NAILG) filed an EB-1A (Alien of Extraordinary Ability) petition on behalf of a biomedical science expert from India, Nebraska Service Center took action on his case and granted their approval. This isn’t our client’s first time filing an I-140 petition—in 2015, his EB-2 NIW petition was approved. However, because of the several-year wait for his priority date to become current, he cannot move on to the next step of the green card process. Now that he has an approved EB-1A, he can jump right in as he no longer has to wait for his priority date to become current several years from now (when adjusting one’s status for permanent residence, different rules apply based on different visa categories).

Building a strong EB-1A case:

It is no secret that EB-1A is upheld by a very high standard of law and has a very low approval rate. Therefore, we needed to detail our client’s accomplishments in the most concise way possible. Our goal was to convince the USCIS that our client is an asset to the United States and that losing his presence in the country would be detrimental to the nation. We started off by detailing our client’s various investigations on the intersection of biomedical science with biotechnology which covers such areas as molecular biology, TRPC/TRPV1/TRPM7 ion channel pharmacology with respect to molecular mechanisms of pain, cardiovascular disease, neurodegenerative disease and breast and lung cancer metastasis. In a nutshell, our attorneys and support staff worked diligently to prove that our client’s findings are essential to the progress of the American medical sector.

Besides accounting for his research projects, we also noted their various results. For instance, we listed the 70 times our client’s findings were cited by other researchers, the 9 times he conducted peer reviews for scientific journals, and the 9 publications to his name. To bolster his EB-1A petition packet, we also incorporated 10 recommendation letters volunteered by other top minds in the field. From a principal investigator in Ireland to a professor in the US, our client’s peers contributed their support by signing off on statements such as this one: “The international scope of his research is self-evident. In the United States, where scientists are constantly searching for better pharmacological treatments, [Client] is producing research that directly benefits these interests. Not only that, but his work is relevant across the globe to the many nations in which cardiovascular disease and diabetes are problems. His research is applicable to a wide variety of disease states, and he is helping to better understand some of the most worthwhile issues in the world.”

We congratulate our client for securing a highlight sought-after EB-1A petition approval and we thank him for choosing our law firm to represent his case. We also congratulate him for recently securing a green card with the help of our DIY Packet. We wish him the best as he embarks on new beginnings here in the US.
