On November 1st, 2021, we received another EB-2 NIW (National Interest Waiver) approval for a Visiting Scholar in the Field of Synthetic Chemistry (Approval Notice).

General Field: Synthetic Chemistry

Position at the Time of Case Filing: Visiting Scholar

Country of Origin: Mauritius

State of Residence at the Time of Filing: Florida

Approval Notice Date: November 1st, 2021

Processing Time: 10 months, 11 days

Case Summary:

Since its inception, North America Immigration Law Group has had the opportunity of serving thousands of clients working in areas ranging from V2X Communications to Cancer Immunotherapy. It goes without saying that our team has honed themselves at this job which makes it possible for them to attend to the ever-changing demands of the clients and the adjudicating authorities at USCIS. It is this that has provided our team with the necessary tools to tackle clients with different requirements.

Whenever we get a client from any walk of life, we follow the routine procedure of checking up on their credentials and then collecting any and all necessary documents pertaining to their academic and professional career. These documents are used to provide us with data that is later used in the petition letter. The petition letter is supported by documents such as letters of recommendation from experts in the field, updated CVs, transcripts from various institutions, etc. This forms the petition packet which is then sent to USCIS for adjudication. The adjudicating bench takes into consideration the petition and depending on several factors, the case gets approval in its due course.

So, when a visiting scholar in the field of synthetic chemistry from Mauritius came to us with her request for filing an NIW (National Interest Waiver) petition, our team responded according to our protocol. We were quick to find that her proposed endeavor is to continue her research on developing polymer networks with enhanced properties using sustainable methods to produce novel polymers useful for applications such as drug delivery systems, rechargeable batteries, and multifunctional materials. This made it evident that her research advancing her proposed endeavor is of great importance because it reduces the amount of plastic waste in the world by making biodegradable polymers a viable alternative to conventional synthetic polymers.

After some deliberation, we settled on 4 recommendation letters that we included in her packet for USCIS. A few excerpts are quoted from these below:

“[The client] developed a better catalytic system for the production of these two sought-after polymers that were more environmentally friendly, solvent-free, and operated at low carbon dioxide pressures. [Client’s] research on this project benefits both manufacturers as well as the environment as her proposed system is more efficient and sustainable than the current alternative.”

“[Client’s] work to improve anticancer drug delivery systems is vital to the United States, as cancer is the second leading cause of death in the country. There have been 1.8 million cancer cases diagnosed in 2020 so far in the United States, with over 600,000 resulting deaths.”

“[Client’s] work improves the applicability of flame retardants while also making them environmentally friendly and sustainable. Due to the increasing fire-related death toll and property damages in the United States, [client’s] work is deeply important and beneficial to the nation.”

On the balance:

  • Her academic performance was gauged by the 9 peer-reviewed journal articles (6 of them first-authored) that she had published.
  • These papers were published in no fewer than 5 highly ranked peer-reviewed journals.
  • These publications have been cited a total of 143 times.
  • Furthermore, her study has received funding from the National Research Foundation, South Africa.
  • Her study has also been supported by funding from the Department of Science and Technology of India.
  • We highlighted at the end that her research into biomedical applications of biodegradable, sustainable polymers will continue to be circulated to others in the field through the publication of papers in peer-reviewed journals and conference presentations.

All of these information pieces were put together in such a convincing manner that it was no surprise to hear of the case approval from USCIS. We are glad of having helped her in this process and we look forward to many further collaborations with similar clients in the future.

This he was able to do and of the following excerpts are taken from them to illustrate how we at NAILG pay attention to these details for our clients:

“[Client’s]work is especially significant today because of the increasing size, complexity, and global integration of supply chains. While these factors have expanded the scope and improved the quality of goods available to consumers worldwide, they also combine to make supply chains fragile. [Client’s] contributions facilitate enhanced supply chain planning, thereby increasing the resilience of those networks to safety incidents and other unexpected mishaps. [Client’s] research on supply chains is also beneficial to the United States.”

“[Client’s] ongoing research also addresses safety issues for various chemicals used in the United States, such as propane. For reference, more than 10% of U.S. homes currently rely on propane. Therefore, it is evident that U.S. consumers must be informed on the hazards, consequences, and risks of propane gas use in order to prevent chemical incidents and hazard-related fatalities. [Client’s] ongoing work ultimately assists in achieving this goal as well.”

On the other hand, his research has resulted in 4 peer-reviewed journal articles (3 of them first-authored). Moreover, one of these papers has been published in a top journal in the field, reflecting his peers’ recognition of the value of this research. Not only has he successfully completed and published the results of his research in the field, but his research has also gone on to influence his peers. That is, his publications have been cited a total of 101 times. He has also completed at least 45 reviews to date. Given that only the most highly esteemed researchers in the field are invited to evaluate the work of their peers, especially in notable journals like these, it is clear that he is seen as very knowledgeable in the field and an expert in topics related to his proposed endeavor.

Thus, we are proud of having been given the opportunity to help him in this case and we thank him for retaining us for his EB1-A petition too.

These are excerpts taken from the letters of recommendation for a very talented client from India who came to NAILG for help with her EB1-A (Alien of Extraordinary Ability) petition filing. Our team signed her on after ascertaining the value of her claims through a background check. We were able to find the following:

  • She is one of the few leading experts in biochemistry focusing on protein-protein interactions, and she has achieved a consistent and notable record of success and influence in this area of study. She is especially well-known for her work on the identification of novel protein–protein and protein-lipid interactions related to general cardiomyopathy and inflammation.
  • She has spent years investigating issues related to protein–protein interactions and is regarded as an authority in the field of biochemistry. The field has recognized her authority by inviting her to review and evaluate the work of her peers no fewer than 15 times.
  • In addition to directly advancing information about protein–protein interactions in human diseases through her original research and peer review service, she has actively engaged her peers in the field of biochemistry by authoring and co-authoring 7 peer-reviewed journal articles and one editorial that have been published in international journals.
  • Moreover, her work has attracted a wide audience and has been cited by researchers both in the United States and abroad.
  • She also submitted evidence of 154 citations, along with 5 letters from experts in the field attesting to the importance and significance of her contributions.

These statements and related objective evidence proved her active and actual participation in the field, leading her case to victory despite an RFE (Request for Evidence). We are grateful to her for trusting us and retaining us for her NIW and I-485 petitions.

Case Summary:

It would be an understatement if someone said that the process of obtaining a green card is not easy. It is in this that North America Immigration Law Group helps its clients, by helping make sense of the legal side of the immigration process. We have thousands of case approvals under our belt, which gives us an edge in the adjudication process. So, when a Senior Bioprocess CMC formation Scientist from India approached us for his I-140 NIW (National Interest Waiver) application and later for his EB-1A (Alien of Extraordinary Ability) petition, we made sure that we tailored the petition to fit his requirements. For this, we did an extensive background check and finally countersigned the retainer agreement.

We made sure that his academic and professional achievements were not overshadowed. For this, we included a summary of his publications, the citation records, and a list of reviewing posts he had been called for in the past, all of which showcased the fact that his research is of value to his peers and that his expertise is relied upon in the field of colloidal chemistry at large. This made certain that his application was a good fit for the very competitive criteria set for both NIW as well as the EB-1A by USCIS.

Moreover, we noted the 14 peer-reviewed journal articles, 1 conference paper, and 3 patents he published in some of the most discerning, high-impact journals in his field. His publications have also been cited a total of 810 times according to Google Scholar, thereby demonstrating that these publications are widely recognized and relied upon in the field of colloidal chemistry. He has already conducted 12 peer reviews for highly remarkable journals. Only the foremost experts in their field are invited to perform this important review work, so this frequent review activity further demonstrates his elevated standing in the field.

His research has also been supported by funding from leading agencies, demonstrating the recognized value and importance of his work. This funding includes grants from the Louisiana Biomedical Research Foundation, the Gulf of Mexico Research Initiative, the Russian Science Foundation, the U.S. National Science Foundation, and the Civilian Research and Development Foundation, each of which are major research facilitators that in total has delivered billions of dollars of funding to thousands of researchers around the world.

For this reason, two of the recommenders had the following to say about his work:

“[Client’s] work on self-assembly, with its multiple applications, benefits countless industries and scientific research with practical and cost-effective fabrication techniques. The textile manufacturing sector especially benefits from this research, as it allows for the development of stronger, more efficient textiles in general… Because his work directly upholds advancements in this industry, his research is an undeniable asset to the field and to the world.”

“[Client’s] consistent record of exceptional achievements in colloidal chemistry has pushed him to the forefront of a competitive and fast-paced field, and it is evident that his work has been a betterment to his peers’ independent research. Because of the qualifications and accomplishments, I have outlined above, I respectfully recommend that the United States support his work to the fullest extent possible.”

We are glad to have had the opportunity to represent his NIW as well as his EB-1A petitions to the USCIS and get the approvals successfully. Therefore, we wish him the very best in his future endeavors.
